A bill to be entitled
2An act relating to public records; creating s. 267.076,
3F.S.; creating an exemption from public records
4requirements for information that identifies a donor or
5prospective donor to a publicly owned house museum
6designated by the United States Department of the Interior
7as a National Historic Landmark who desires to remain
8anonymous; providing for future legislative review and
9repeal of the exemption under the Open Government Sunset
10Review Act; providing a statement of public necessity;
11providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 267.076, Florida Statutes, is created
16to read:
17     267.076  Confidentiality of certain donor information
18related to publicly owned house museums designated as National
19Historic Landmarks.--Information that would identify a donor or
20prospective donor to a publicly owned house museum designated by
21the United States Department of the Interior as a National
22Historic Landmark who desires to remain anonymous is
23confidential and exempt from s. 119.07(1) and s. 24(a), Art. I
24of the State Constitution. This section is subject to the Open
25Government Sunset Review Act in accordance with s. 119.15 and
26shall stand repealed on October 2, 2012, unless reviewed and
27saved from repeal through reenactment by the Legislature.
28     Section 2.  The Legislature finds that it is a public
29necessity that information that would identify a donor or
30prospective donor to a publicly owned house museum designated by
31the United States Department of the Interior as a National
32Historic Landmark who desires to remain anonymous be made
33confidential and exempt from public records requirements. In
34order to protect Florida's historic resources, it is a public
35necessity to promote the giving of gifts to, and the raising of
36private funds for, the acquisition, renovation, rehabilitation,
37and operation of publicly owned house museums designated by the
38United States Department of the Interior as National Historic
39Landmarks. An essential element of a robust plan of promoting
40the giving of private gifts and the raising of private funds is
41the need to protect the identity of prospective and actual
42donors who desire to remain anonymous. If the identity of
43prospective and actual donors who desire to remain anonymous is
44subject to disclosure, there is a chilling effect on donations
45because donors are concerned about disclosure of personal
46information leading to theft and, in particular, identity theft,
47including personal safety and security. Therefore, the
48Legislature finds that it is a public necessity to make
49confidential and exempt from public records requirements
50information that would identify a donor or prospective donor to
51a publicly owned house museum designated by the United States
52Department of the Interior as a National Historic Landmark who
53wishes to remain anonymous.
54     Section 3.  This act shall take effect July 1, 2007.
