| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. Section 267.076, Florida Statutes, is created |
| 16 | to read: |
| 17 | 267.076 Confidentiality of certain donor information |
| 18 | related to publicly owned house museums designated as National |
| 19 | Historic Landmarks.--Information that would identify a donor or |
| 20 | prospective donor to a publicly owned house museum designated by |
| 21 | the United States Department of the Interior as a National |
| 22 | Historic Landmark who desires to remain anonymous is |
| 23 | confidential and exempt from s. 119.07(1) and s. 24(a), Art. I |
| 24 | of the State Constitution. This section is subject to the Open |
| 25 | Government Sunset Review Act in accordance with s. 119.15 and |
| 26 | shall stand repealed on October 2, 2012, unless reviewed and |
| 27 | saved from repeal through reenactment by the Legislature. |
| 28 | Section 2. The Legislature finds that it is a public |
| 29 | necessity that information that would identify a donor or |
| 30 | prospective donor to a publicly owned house museum designated by |
| 31 | the United States Department of the Interior as a National |
| 32 | Historic Landmark who desires to remain anonymous be made |
| 33 | confidential and exempt from public records requirements. In |
| 34 | order to protect Florida's historic resources, it is a public |
| 35 | necessity to promote the giving of gifts to, and the raising of |
| 36 | private funds for, the acquisition, renovation, rehabilitation, |
| 37 | and operation of publicly owned house museums designated by the |
| 38 | United States Department of the Interior as National Historic |
| 39 | Landmarks. An essential element of a robust plan of promoting |
| 40 | the giving of private gifts and the raising of private funds is |
| 41 | the need to protect the identity of prospective and actual |
| 42 | donors who desire to remain anonymous. If the identity of |
| 43 | prospective and actual donors who desire to remain anonymous is |
| 44 | subject to disclosure, there is a chilling effect on donations |
| 45 | because donors are concerned about disclosure of personal |
| 46 | information leading to theft and, in particular, identity theft, |
| 47 | including personal safety and security. Therefore, the |
| 48 | Legislature finds that it is a public necessity to make |
| 49 | confidential and exempt from public records requirements |
| 50 | information that would identify a donor or prospective donor to |
| 51 | a publicly owned house museum designated by the United States |
| 52 | Department of the Interior as a National Historic Landmark who |
| 53 | wishes to remain anonymous. |
| 54 | Section 3. This act shall take effect July 1, 2007. |
