6 | permits to a nonprofit civic organization to sell |
7 | alcoholic beverages for consumption on the premises at |
8 | outdoor events on public right-of-way in the downtown area |
9 | of St. Petersburg; providing that such events require a |
10 | street-closure permit from the City of St. Petersburg; |
11 | providing that the permits authorized by the act are in |
12 | addition to certain other authorized temporary permits; |
13 | requiring the nonprofit civic organization to comply with |
14 | certain statutory requirements in obtaining the permits |
15 | authorized by the act; requiring the division to adopt |
16 | rules; providing an effective date. |

18 | Be It Enacted by the Legislature of the State of Florida: |
19 |

20 | Section 1. (1) Notwithstanding any other provision of |
21 | law, the Division of Alcoholic Beverages and Tobacco of the |
22 | Department of Business and Professional Regulation may issue to |
23 | a bona fide nonprofit civic organization, upon application and |
24 | presentation of a valid street-closure permit issued by the City |
25 | of St. Petersburg, a temporary permit authorizing the sale of |
26 | alcoholic beverages for consumption on the premises at outdoor |
27 | events on public right-of-way in the downtown area of St. |
28 | Petersburg. Any such nonprofit civic organization may be issued |
29 | up to 15 temporary permits per calendar year and each temporary |
30 | permit is valid for up to 3 days. For purposes of this act, the |
31 | downtown area of St. Petersburg is that area between 5th Avenues |
32 | North and South and between 16th Street and the waterfront. |
33 | (2) The temporary permits authorized by this act are in |
34 | addition to the three temporary permits authorized per year for |
35 | a nonprofit civic organization pursuant to s. 561.422, Florida |
36 | Statutes. |
37 | (3) The nonprofit civic organization shall comply with all |
38 | other requirements of s. 561.422, Florida Statutes, in obtaining |
39 | the temporary permits authorized by this act. |
40 | (4) On or before October 1, 2007, the Division of |
41 | Alcoholic Beverages and Tobacco of the Department of Business |
42 | and Professional Regulation shall adopt rules pursuant to |
43 | chapter 120, Florida Statutes, to administer this act. Such |
44 | rules shall include permitting procedures and application forms. |
45 | Section 2. This act shall take effect upon becoming a law. |
