9 requiring a report to the Legislature;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 409.91194, Florida Statutes, is
15 created to read:
16 409.91194 Medical Care Advisory Committee.--
17 (1) The Secretary of Health Care Administration shall
18 appoint a Medical Care Advisory Committee to advise the Agency
19 for Health Care Administration about the Florida Medicaid
20 program, consistent with the requirements of federal law.
21 (2) The committee shall be composed of not fewer than
22 15 or more than 25 members, with at least 51 percent of the
23 membership consisting of current or former Medicaid
24 recipients, their parents or guardians, or Medicaid advocates,
25 including representatives of special needs populations. The
26 terms of office of the members shall be for 3 years, and
27 members may serve no more than two consecutive 3-year terms.
28 However, a term of less than 3 years may be used to ensure
29 that no more than five members' terms expire during the same
30 calendar year. A vacancy occurring during a term shall be

1 filled for the unexpired portion of the term in the same
2 manner as the initial appointment was made.
3 (3) At the first meeting each year, the members shall
4 elect a chair and a vice chair. The committee shall meet at
5 least quarterly, and committee members shall be provided
6 written notice of the meetings at least 20 days before the
7 date of the meeting. Subject to appropriation, the Agency for
8 Health Care Administration shall provide staff and
9 administrative support to the committee for the committee's
10 activities and duties as provided in this section.
11 (4) The members of the committee shall serve without
12 compensation, but are entitled to reimbursement for per diem
13 and travel expenses incurred in the discharge of official
14 duties as provided in s. 112.061.
15 (5) The duties and responsibilities of the committee
16 include, but are not limited to, reviewing and commenting upon
17 proposed amendments to the Medicaid state plan; reviewing and
18 commenting upon proposed new Medicaid initiatives pertaining
19 to health care benefits and beneficiary eligibility, including
20 Medicaid waiver proposals and programs; participating in the
21 development of policies and standards; providing advice about
22 the content and dissemination of program materials; and
23 providing advice about gaps in services or barriers to the use
24 of services. The committee shall study and make
25 recommendations regarding other Medicaid-related topics as
26 suggested by the Legislature or the chair of the committee.
27 The committee shall provide a written report on its activities
28 and recommendations on or before November 30 of each year to
29 the Governor, the President of the Senate, and the Speaker of
30 the House of Representatives.
31 Section 2. This act shall take effect July 1, 2007.
