11  The Committee on Regulated Industries (Fasano) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Section 509.054, F.S., is created to read:
19         509.054  Restroom Inspections.--
20         (1)  The division shall inspect each public food
21  service establishment and its toilet facilities pursuant to s.
22  509.032, as often as necessary to ensure compliance with
23  applicable laws and rules.  A toilet facility in a public food
24  service establishment must meet the following minimum
25  sanitation standards:
26         (a)  Each toilet facility located on the premises of
27  the public food service establishment must be completely
28  enclosed and provided with a tight-fitting, self-closing door
29  or have entrances and exits constructed in such a manner as to
30  ensure the privacy of occupants. Such door may not be left
31  open except during cleaning or maintenance.

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1462 Barcode 934480 1 (b) Toilet facilities that are used by patrons must be 2 situated so that a patron does not pass through 3 food-preparation or utensil-washing areas. 4 (c) Toilet fixtures must be cleanable. 5 (d) Toilet facilities, including rooms and fixtures, 6 must be kept clean and in good repair. 7 (e) The floors must be made of a nonabsorbent material 8 and cleaned daily. The requirement that floors be made of a 9 nonabsorbent material applies only to public food service 10 establishments that are constructed or substantially remodeled 11 after July 1, 2007. 12 (f) Receptacles must be provided for waste material, 13 and such receptacles must contain a trash-can liner. These 14 receptacles in toilet facilities for women must be covered. 15 Receptacles must be emptied as necessary to prevent excessive 16 accumulation of waste material. 17 (g) A supply of hand-cleansing, antibacterial soap or 18 detergent must be available in each toilet facility, and 19 running water must be available at each hand-washing sink 20 within a toilet facility. A supply of sanitary towels or a 21 hand-drying device providing heated air must be located in 22 each toilet facility. Applicable to public food service 23 establishments that are constructed or substantially remodeled 24 after July 1, 2007, hot and cold running water must be 25 available at each hand-washing sink within a toilet facility, 26 and hand-washing sinks that have an automatic shut-off must 27 run for a minimum of 20 seconds. Hand-washing sinks, soap 28 dispensers, hand-drying devices, and all related fixtures must 29 be kept clean and in good repair. 30 (h) A supply of toilet tissue must be provided in each 31 toilet stall at all times. 2 8:33 AM 04/13/07 s1462.ri11.001

This requirement applies only to public food 3 service establishments that are constructed or substantially 4 remodeled after July 1, 2007. 5 (j) A sign or poster that notifies food service 6 employees to wash their hands must be provided at each 7 hand-washing sink used by public food service employees and 8 must be clearly visible to the food service employees. 9 (2) This section does not apply to restrooms in a 10 public airport as defined in ss. 320.27(2) and 330.27(6) which 11 are not located within a public food service establishment. 12 (3) If the director determines that a violation of the 13 minimum sanitation standards in this section represents a 14 severe and immediate public health or safety or welfare 15 threat, the division shall, upon proper finding, immediately 16 issue an emergency order to close an establishment licensed 17 under this chapter pursuant to the procedures for emergency 18 orders in s. 509.035. 19 Section 2.
