| 1 | A bill to be entitled |
| 2 | An act relating to overdue assessments and fees; requiring |
| 3 | that property owners be notified by certified or |
| 4 | registered mail of liens against property which arise from |
| 5 | debts owed to a homeowner's association, cooperative |
| 6 | association, or condominium association; providing for |
| 7 | payment within specified period with interest for |
| 8 | attorney's fees that result from liens against the |
| 9 | property; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |

| 13 | Section 1. (1) Any association regulated under chapter |
| 14 | 718, chapter 719, or chapter 720, Florida Statutes, which files |
| 15 | a lien upon a property covered by the association because the |
| 16 | property owner does not pay an assessment or other fee owed to |
| 17 | the association, upon filing the lien, must notify the property |
| 18 | owner by certified or registered mail. |
| 19 | (2) If attorney's fees are assessed against the property |
| 20 | owner as a result of the association's efforts to collect the |
| 21 | debt that resulted in the lien, the property owner shall pay the |
| 22 | attorney's fees before a period of 90 days has expired, |
| 23 | including interest at the standard interest rate for such debts. |
| 24 | Section 2. This act shall take effect July 1, 2007. |
