A bill to be entitled
2An act relating to overdue assessments and fees; requiring
3that property owners be notified by certified or
4registered mail of liens against property which arise from
5debts owed to a homeowner's association, cooperative
6association, or condominium association; providing for
7payment within specified period with interest for
8attorney's fees that result from liens against the
9property; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  (1)  Any association regulated under chapter
14718, chapter 719, or chapter 720, Florida Statutes, which files
15a lien upon a property covered by the association because the
16property owner does not pay an assessment or other fee owed to
17the association, upon filing the lien, must notify the property
18owner by certified or registered mail.
19     (2)  If attorney's fees are assessed against the property
20owner as a result of the association's efforts to collect the
21debt that resulted in the lien, the property owner shall pay the
22attorney's fees before a period of 90 days has expired,
23including interest at the standard interest rate for such debts.
24     Section 2.  This act shall take effect July 1, 2007.
