1 A bill to be entitled
2 An act relating to medical specialties;
3 amending ss. 458.3312 and 459.0152, F.S.;
4 revising requirements for the classification of
5 a physician or osteopathic physician as a
6 board-certified specialist; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 458.3312, Florida Statutes, is
12 amended to read:
13 458.3312 Specialties.--A physician licensed under this
14 chapter may not hold himself or herself out as a
15 board-certified specialist unless the physician has received
16 formal recognition as a specialist from a specialty board of
17 the American Board of Medical Specialties or other recognizing
18 agency approved by the board which requires completion of an
19 approved residency or fellowship training program from the
20 Accreditation Council for Graduate Medical Education in the
21 specialty of certification. However, a physician may indicate
22 the services offered and may state that his or her practice is
23 limited to one or more types of services when this accurately
24 reflects the scope of practice of the physician.
25 Section 2. Section 459.0152, Florida Statutes, is
26 amended to read:
27 459.0152 Specialties.--An osteopathic physician
28 licensed under this chapter may not hold himself or herself
29 out as a board-certified specialist unless the osteopathic
30 physician has successfully completed the requirements for
31 certification by the American Osteopathic Association or the

1 Accreditation Council on Graduate Medical Education and is
2 certified as a specialist by a certifying agency approved by
3 the board which requires completion of an approved residency
4 or fellowship training program from the American Osteopathic
5 Association in the specialty of certification. However, an
6 osteopathic physician may indicate the services offered and
7 may state that his or her practice is limited to one or more
8 types of services when this accurately reflects the scope of
9 practice of the osteopathic physician.
10 Section 3. This act shall take effect July 1, 2007.
