1 A bill to be entitled
2 An act relating to trust funds; creating the
3 Medical Trust Fund within the Agency for
4 Persons with Disabilities; providing for uses
5 and sources of funds; providing for an annual
6 carryforward of funds; providing for future
7 review and termination or re-creation of the
8 fund; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Medical Trust Fund.--
13 (1) The Medical Trust Fund is created within the
14 Agency for Persons with Disabilities. Funds credited to the
15 trust fund shall consist of moneys appropriated by the
16 Legislature from fees for services, the Medicaid waiver
17 program, Medicaid, social security, railroad retirement,
18 third-party payments, and cash received or collected from
19 medical services rendered to developmentally disabled
20 community residents by developmental disability institutions
21 operated by the Agency for Persons with Disabilities.
22 (2) Moneys shall be appropriated by the Legislature
23 for this trust fund for the purpose of providing medical
24 services to developmentally disabled community residents,
25 including, but not limited to, medical, dental, therapeutic,
26 occupational, physical therapy, audiological, psychiatric, and
27 speech services on an as-needed basis. The Legislature shall
28 also appropriate moneys to this trust fund for the purpose of
29 providing respite services, crisis stabilization, hospice
30 services in an inpatient setting for up to 180 days, and other
31 related services for developmentally disabled residents,

1 including, but not limited to, employing or contracting for
2 medical support personnel, related administrative personnel,
3 and the purchase or maintenance of facilities or equipment for
4 medical services for the developmentally disabled.
5 (3) Notwithstanding s. 216.301, Florida Statutes, and
6 pursuant to s. 216.351, Florida Statutes, any balance in the
7 trust fund at the end of a fiscal year shall remain in the
8 trust fund and be available for carrying out the purposes of
9 the trust fund.
10 (4) Pursuant to s. 19(f)(2), Art. III of the State
11 Constitution, the trust fund shall, unless terminated sooner,
12 be terminated on July 1, 2011. However, before its scheduled
13 termination, the trust fund shall be reviewed as provided in
14 s. 215.3206(1) and (2), Florida Statutes.
15 Section 2. This act shall take effect July 1, 2007.
