| 5 | Section 2. Effective upon this act becoming a law, |
| 6 | subsection (5) is added to section 163.31801, Florida Statutes, |
| 7 | to read: |
| 8 | 163.31801 Impact fees; short title; intent; definitions; |
| 9 | ordinances levying impact fees.-- |
| 10 | (5)(a) A local government may not increase an existing |
| 11 | impact fee in any single fiscal year by more than the percentage |
| 12 | change in the Consumer Price Index for all urban consumers, U.S. |
| 13 | City Average, all items 1982-1984=100, or successor reports for |
| 14 | the 12-month period through June prior to the beginning of the |
| 15 | fiscal year, as initially reported by the United States |
| 16 | Department of Labor, Bureau of Labor Statistics. |
| 17 | (b) The total of all impact fees collected by a local |
| 18 | government on a construction project shall equal no more than 5 |
| 19 | percent of the actual cost of construction. |
| 20 | Section 3. Except as otherwise expressly provided by this |
| 21 | act, this act shall take effect July 1, 2007. |
