3     Amendment (with title amendment)
4     Remove line 49, and insert:
5     Section 2.  Effective upon this act becoming a law,
6subsection (5) is added to section 163.31801, Florida Statutes,
7to read:
8     163.31801  Impact fees; short title; intent; definitions;
9ordinances levying impact fees.--
10     (5)(a)  A local government may not increase an existing
11impact fee in any single fiscal year by more than the percentage
12change in the Consumer Price Index for all urban consumers, U.S.
13City Average, all items 1982-1984=100, or successor reports for
14the 12-month period through June prior to the beginning of the
15fiscal year, as initially reported by the United States
16Department of Labor, Bureau of Labor Statistics.
17     (b)  The total of all impact fees collected by a local
18government on a construction project shall equal no more than 5
19percent of the actual cost of construction.
20     Section 3. Except as otherwise expressly provided by this
21act, this act shall take effect July 1, 2007.
