18         Section 1.  Part IV of chapter 369, Florida Statutes,
19  consisting of sections 369.401, 369.402, 369.403, and 369.404,
20  is created to read:

22                        SPRINGS PROTECTION
23         369.401  Short title.--This part may be cited as the
24  "Florida Springs Stewardship Act."
25         369.402  Legislative findings and intent.--The
26  Legislature finds that:
27         (1)  Florida's springs are valuable resources that
28  provide recreational and tourism opportunities and are a great
29  financial benefit to local economies and that Florida's
30  springs provide critical habitat for endangered or threatened
31  species of plants and animals.

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1486 Barcode 554832 1 (2) The flow and water quality of Florida's springs 2 are direct reflections of the aquifer systems in Florida and 3 consequently are indicators of the condition of a significant 4 portion of the state's water supply. 5 (3) Cooperative efforts can best develop the 6 mechanisms to identify best management practices for the 7 protection, restoration, and preservation of Florida's 8 springs. 9 (4) The citizens of Florida desire to be good stewards 10 of the state's resources and that through educational 11 awareness programs will voluntarily implement best management 12 practices into their daily activities. 13 (5) The most cost-effective means to provide 14 protection, restoration, and preservation of Florida's springs 15 is through a nonregulatory approach. 16 369.403 Definitions.--For purposes of this part, the 17 term: 18 (1) "Seep" means a place where the water table aquifer 19 intersects the land surface and flows onto the land. 20 (2) "Spring" means a point where groundwater is 21 discharged onto the earth's surface, including under any 22 surface water of the state, and excluding seeps. 23 (3) "Zone of influence" means the geographic area that 24 contributes most directly to the water quantity and quality of 25 a spring. 26 369.404 Florida Springs Stewardship Task Force.-- 27 (1) The Florida Springs Stewardship Task Force is 28 hereby created and shall consist of eight members as follows: 29 (a) One representative from the Department of 30 Environmental Protection to be appointed by the Secretary of 31 Environmental Protection; 2 2:05 PM 04/17/07 s1486c1d-ca26-r8g
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1486 Barcode 554832 1 (b) One representative from the Department of 2 Agriculture and Consumer Services to be appointed by the 3 Commissioner of Agriculture; 4 (c) One representative from the water management 5 district with the greatest number of first magnitude springs 6 within its jurisdiction to be appointed by the executive 7 director of that water management district; 8 (d) Two members appointed by the President of the 9 Senate, one of whom shall be a representative of the 10 development community and one of whom shall be a 11 representative of a local chamber of commerce; 12 (e) Two members appointed by the Speaker of the House 13 of Representatives, one of whom shall be a locally elected 14 county or municipal official and one of whom shall be a 15 representative of the environmental community; and 16 (f) One member appointed by the Commissioner of 17 Agriculture who shall be a representative of the agricultural 18 community. 19 (2) Task force members shall be appointed no later 20 than August 1, 2007. Members shall choose a chair and 21 vice-chair from the membership of the task force. 22 (3) The task force shall: 23 (a) Collect and inventory all existing data 24 identifying zones of influence for each of Florida's 33 known 25 first magnitude springs and identifying land uses in these 26 areas. 27 (b) Identify and compile a list of existing best 28 management practices for identified land uses. 29 (c) Identify any and all existing and reasonably 30 expected funding sources available to implement best 31 management practices that protect Florida's first magnitude 3 2:05 PM 04/17/07 s1486c1d-ca26-r8g
Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. CS for SB 1486 Barcode 554832 1 springs and propose a priority list of projects for the 2 funding. 3 (d) Take public input and testimony regarding issues 4 related to spring protection, restoration, and preservation. 5 (e) Propose a program of increased emphasis on 6 education and outreach that encourages the implementation of 7 best management practices for agricultural and nonagricultural 8 land uses, including specific provisions for cost-share 9 assistance with the implementation of best management 10 practices as well as recognition of agricultural and 11 nonagricultural landowners who participate in the best 12 management practices program. 13 (4) The task force shall submit a report summarizing 14 the data collected, public input and testimony, and the 15 findings and proposals of the task force to the President of 16 the Senate and the Speaker of the House of Representatives no 17 later than January 31, 2008. 18 (5) All state agencies are directed, and all other 19 agencies and local governments are requested, to render 20 assistance to and cooperate with the task force. 21 (6) The task force shall expire on January 31, 2008. 22 Section 2.
