3     Amendment (with title amendment)
4     Remove lines 38-89 and insert:
5     (1)  The term "local government" as used in this section
6means a county, municipality, special district as defined in
7chapter 189, or other political subdivision of the state.
8     (2)  A local government may select a construction-
9management entity, pursuant to the process provided by s.
10287.055, that would be responsible for construction project
11scheduling and coordination in both preconstruction and
12construction phases and is generally responsible for the
13successful, timely, and economical completion of the
14construction project. The construction-management entity shall
15consist of or contract with licensed or registered professionals
16for the specific fields or areas of construction to be
17performed, as required by law. The construction-management
18entity may retain necessary design professionals selected under
19the process provided in s. 287.055. At the option of the local
20government, the construction-management entity, after being
21selected and after competitive negotiations, may be required to
22offer a guaranteed maximum price or a guaranteed completion
23date, in which case, the construction-management entity shall
24secure an appropriate surety bond pursuant to s. 255.05 and
25shall hold construction subcontracts. If a project, as defined
26in s. 287.055(2)(f), solicited by a local government under the
27process provided in s. 287.055 includes a grouping of
28substantially similar construction, rehabilitation, or
29renovation activities as permitted under s. 287.055(2)(f), the
30local government, after competitive negotiations, may require
31the construction-management entity to provide for a separate
32guaranteed maximum price or a separate lump-sum price and a
33separate guaranteed completion date for each grouping of
34substantially similar construction, rehabilitation, or
35renovation activities included under the project.
36     (3)  A local government may select a program-management
37entity, pursuant to the process provided by s. 287.055, that
38would be responsible for schedule control, cost control, and
39coordination in providing or procuring planning, design, and
40construction services. The program-management entity shall
41consist of or contract with licensed or registered professionals
42for the specific areas of design or construction to be
43performed, as required by law. The program-management entity may
44retain necessary design professionals selected under the process
45provided in s. 287.055. At the option of the local government,
46the program-management entity, after being selected and after
47competitive negotiations, may be required to offer a guaranteed
48maximum price or a lump-sum price and a guaranteed completion
49date, in which case the program-management entity shall secure
50an appropriate surety bond pursuant to s. 255.05 and shall hold
51design and construction subcontracts. If a project, as defined
52in s. 287.055(2)(f), solicited by a local government under the
53process provided in s. 287.055, includes a grouping of
54substantially similar construction, rehabilitation, or
55renovation activities as permitted under s. 287.055(2)(f), the
56local government, after competitive negotiations, may require
57the program-management entity to provide for a separate
58guaranteed maximum price or a lump-sum price and a separate
59guaranteed completion date for each grouping of substantially
60similar construction, rehabilitation, or renovation activities
61included under the project.
62     (4)  Nothing in this section shall be construed to prohibit
63a local government from procuring construction-management
64services, including the services of a program-management entity,
65pursuant to the requirements of s. 255.20.
