12 following amendment:

15 Delete everything after the enacting clause

17 and insert:
18 Section 1. Section 348.52, Florida Statutes, is
19 amended to read:
20 348.52 Tampa-Hillsborough County Expressway
21 Authority.--
22 (1) There is hereby created and established a body
23 politic and corporate, an agency of the state, to be known as
24 the "Tampa-Hillsborough County Expressway Authority."
25 (2) The governing body of the authority shall consist
26 of a board of seven members.
27 (a) Four of the members shall be appointed by the
28 Governor subject to confirmation by the Senate at the next
29 regular session of the Legislature. Refusal or failure of the
30 Senate to confirm an appointment shall create a vacancy.

1 years or until his or her successor shall have been appointed
2 and qualified.
3 2. Vacancies occurring in the governing body for any
4 such members prior to the expiration of the affected term
5 shall be filled for the unexpired term.
6 3. The Governor shall have the authority to remove
7 from office any such member of the governing body in the
8 manner and for cause defined by the laws of this state.
9 4. Each such member, before entering upon his or her
10 official duties, shall take and subscribe to an oath before
11 some official authorized by law to administer oaths that he or
12 she will honestly, faithfully, and impartially perform the
13 duties devolving upon him or her in office as a member of the
14 governing body of the authority and that he or she will not
15 neglect any duties imposed upon him or her by this part.
16 5. Notwithstanding subparagraphs 1. and 3., the terms
17 of each member previously appointed under the provisions of
18 this paragraph shall expire July 31, 2007 and four members
19 shall be appointed by the Governor. For the purpose of
20 staggering terms, two of the appointments made under this
21 subparagraph shall be appointed to an initial term of two
22 years. Nothing here shall be interpreted to prevent the
23 Governor from reappointing a person who has previously served
24 on the authority to a new term.
25 (b) One member shall be the mayor, or the mayor's
26 designate, who shall be the chair of the city council of the
27 city in Hillsborough County having the largest population,
28 according to the latest decennial census, who shall serve as a
29 member ex officio.
30 (c) One member shall be a member of the Board of
31 County Commissioners of Hillsborough County, selected by such

1 board, who shall serve as a member ex officio.
2 (d) One member shall be the district secretary of the
3 Department of Transportation serving in the district that
4 contains Hillsborough County, who shall serve ex officio.
5 (3) The authority shall designate one of its members
6 as chair. The members of the authority shall not be entitled
7 to compensation but shall be entitled to receive their travel
8 and other necessary expenses as provided in s. 112.061. A
9 majority of the members of the authority shall constitute a
10 quorum, and resolutions enacted or adopted by a vote of a
11 majority of the members present and voting at any meeting
12 shall become effective without publication or posting or any
13 further action of the authority.
14 (4) The authority may employ a secretary and executive
15 director, its own counsel and legal staff, and such legal,
16 financial, and other professional consultants, technical
17 experts, engineers, and employees, permanent or temporary, as
18 it may require and may determine the qualifications and fix
19 the compensation of such persons, firms, or corporations. The
20 authority may contract with the Division of Bond Finance of
21 the State Board of Administration for any financial services
22 authorized herein.
23 (5) The authority may delegate to one or more of its
24 officers or employees such of its powers as it shall deem
25 necessary to carry out the purposes of this part, subject
26 always to the supervision and control of the authority.
27 Members of the authority may be removed from their office by
28 the Governor for misconduct, malfeasance, misfeasance, and
29 nonfeasance in office.
30 Section 2. This act shall take effect July 1, 2007.
