  1                      A bill to be entitled
  2         An act relating to the Tampa-Hillsborough
  3         County Expressway Authority; amending s.
  4         348.51, F.S.; redefining the term "city" to
  5         include any incorporated municipality within
  6         Hillsborough County; amending s. 348.52, F.S.;
  7         revising the membership of the governing body
  8         of the authority; providing for certain members
  9         of the authority to be appointed by the
10         governing body of specified municipalities;
11         providing for the Board of County Commissioners
12         of Hillsborough County to appoint additional
13         members to the authority; authorizing the
14         appointing governing body to remove its
15         appointee from the authority by a super
16         majority vote; providing for staggered terms of
17         office for the initial terms of members
18         appointed under the act; providing an effective
19         date.

21  Be It Enacted by the Legislature of the State of Florida:
22  
23         Section 1.  Subsections (4) and (7) of section 348.51,
24  Florida Statutes, are amended to read:
25         348.51  Definitions.--The following terms whenever used
26  or referred to in this part shall have the following meanings,
27  except in those instances where the context clearly indicates
28  otherwise:
29         (4)  "City" means an incorporated municipality within
30  the County of Hillsborough the City of Tampa.

 1         (7)  "Expressway system" or "system" means, generally,
 2  a modern highway system of roads, bridges, causeways, and
 3  tunnels in the metropolitan area of a the city, or within any
 4  area of the county, with access limited or unlimited as the
 5  authority may determine, and such buildings and structures and
 6  appurtenances and facilities related thereto, including all
 7  approaches, streets, roads, bridges, and avenues of access for
 8  such system.
 9         Section 2.  Section 348.52, Florida Statutes, is
10  amended to read:
11         348.52  Tampa-Hillsborough County Expressway
12  Authority.--
13         (1)  There is hereby created and established a body
14  politic and corporate, an agency of the state, to be known as
15  the "Tampa-Hillsborough County Expressway Authority."
16         (2)  The governing body of the authority shall consist
17  of a board of seven members.
18         (a)  One member shall be appointed by the governing
19  body of the City of Tampa.
20         (b)  One member shall be appointed by the governing
21  body of the City of Temple Terrace.
22         (c)  One member shall be appointed by the governing
23  body of the City of Plant City.
24         (d)  Three members shall be appointed by the Board of
25  County Commissioners of Hillsborough County.
26         (e)  One member shall be the district secretary of the
27  Department of Transportation serving in the district that
28  contains Hillsborough County, who shall serve ex officio.
29         (a)  Four of the members shall be appointed by the
30  Governor subject to confirmation by the Senate at the next

 1  regular session of the Legislature. Refusal or failure of the
 2  Senate to confirm an appointment shall create a vacancy.
 3         (3)1.  Each such member's term of office shall be for 4
 4  years or until his or her successor shall have been appointed
 5  and qualified. However, for the purpose of providing staggered
 6  terms, of the initial appointments the first term of the
 7  appointee of the City of Plant City and the first term of one
 8  of the appointees of Hillsborough County shall be for 2 years.
 9         (4)2.  Vacancies occurring in the governing body for
10  any such members prior to the expiration of the affected term
11  shall be filled for the unexpired term in the same manner as
12  the original appointment.
13         (5)3.  The Governor shall have the authority to remove
14  from office any such member of the governing body in the
15  manner and for cause defined by the laws of this state. The
16  appointing governing body may recall any member appointed by
17  it and may remove the appointee from the governing body of the
18  authority by a super majority vote of the appointing governing
19  body.
20         (6)4.  Each such member, before entering upon his or
21  her official duties, shall take and subscribe to an oath
22  before some official authorized by law to administer oaths
23  that he or she will honestly, faithfully, and impartially
24  perform the duties devolving upon him or her  in office as a
25  member of the governing body of the authority and that he or
26  she will not neglect any duties imposed upon him or her by
27  this part.
28         (b)  One member shall be the mayor, or the mayor's
29  designate, who shall be the chair of the city council of the
30  city in Hillsborough County having the largest population,

 1  according to the latest decennial census, who shall serve as a
 2  member ex officio.
 3         (c)  One member shall be a member of the Board of
 4  County Commissioners of Hillsborough County, selected by such
 5  board, who shall serve as a member ex officio.
 6         (d)  One member shall be the district secretary of the
 7  Department of Transportation serving in the district that
 8  contains Hillsborough County, who shall serve ex officio.
 9         (7)(3)  The authority shall designate one of its
10  members as chair. The members of the authority shall not be
11  entitled to compensation but shall be entitled to receive
12  their travel and other necessary expenses as provided in s.
13  112.061.  A majority of the members of the authority shall
14  constitute a quorum, and resolutions enacted or adopted by a
15  vote of a majority of the members present and voting at any
16  meeting shall become effective without publication or posting
17  or any further action of the authority.
18         (8)(4)  The authority may employ a secretary and
19  executive director, its own counsel and legal staff, and such
20  legal, financial, and other professional consultants,
21  technical experts, engineers, and employees, permanent or
22  temporary, as it may require and may determine the
23  qualifications and fix the compensation of such persons,
24  firms, or corporations.  The authority may contract with the
25  Division of Bond Finance of the State Board of Administration
26  for any financial services authorized herein.
27         (9)(5)  The authority may delegate to one or more of
28  its officers or employees such of its powers as it shall deem
29  necessary to carry out the purposes of this part, subject
30  always to the supervision and control of the authority.
31  Members of the authority may be removed from their office by

 1  the Governor for misconduct, malfeasance, misfeasance, and
 2  nonfeasance in office.
 3         Section 3.  This act shall take effect July 1, 2007.

 7    Revises the Tampa-Hillsborough County Expressway
      Authority Law. Redefines the term "city" to include the
 8    incorporated municipalities within Hillsborough County.
      Provides for the governing body of the City of Tampa, the
 9    City of Temple Terrace, and the City of Plant City to
      each appoint a member to the authority. Provides for the
10    Board of County Commissioners of Hillsborough County to
      appoint additional members. Provides for the appointing
