  1                      A bill to be entitled

  2         An act relating to operation of all-terrain

  3         vehicles; amending s. 316.2123, F.S.;

  4         authorizing a local government to limit the use

  5         of all-terrain vehicles to designated unpaved

  6         roadways under certain conditions; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 316.2123, Florida Statutes, is

12  amended to read:

13         316.2123  Operation of an ATV on certain roadways.--

14         (1)  The operation of an ATV, as defined in s.

15  317.0003, upon the public roads or streets of this state is

16  prohibited, except that an ATV may be operated during the

17  daytime on an unpaved roadway where the posted speed limit is

18  less than 35 miles per hour by a licensed driver or by a minor

19  under the supervision of a licensed driver. The operator must

20  provide proof of ownership pursuant to chapter 317 upon

21  request by a law enforcement officer.

22         (2)  A county is exempt from this section if the

23  governing body of the county, by majority vote, following a

24  noticed public hearing, votes to exempt the county from this

25  section. Alternatively, a county may, by majority vote after

26  such a hearing, designate certain unpaved roadways where an

27  ATV may be operated during the daytime so long as each such

28  designated roadway has a posted speed limit of less than 35

29  miles per hour and is appropriately marked to indicate

30  permissible ATV use.

 1         (3)  Any ATV operation that is permitted under

 2  subsection (1) or subsection (2) may be undertaken only by a

 3  licensed driver or a minor who is under the supervision of a

 4  licensed driver. The operator must provide proof of ownership

 5  under chapter 317 upon request by a law enforcement officer.

 6         Section 2.  This act shall take effect upon becoming a

 7  law.
