8 | Be It Enacted by the Legislature of the State of Florida: |
9 |

10 | Section 1. Limitation on increases in the county's |
11 | operating budget.--Except as provided in this section, annual |
12 | increases in Brevard County's operating budget shall not exceed |
13 | the percentage increase in the county's population, as |
14 | determined by the University of Florida Bureau of Economic and |
15 | Business Research's latest Florida Estimates of Population, in |
16 | addition to the percentage change in the Consumer Price Index as |
17 | provided in section 193.155(1)(b), Florida Statutes. This |
18 | limitation in annual increases in the county's operating budget |
19 | may be overcome by a finding of necessity due to emergency or |
20 | critical need approved by a super majority vote of the county |
21 | commission. |
22 | Section 2. Referendum.-- |
23 | (1) In conjunction with the next general election, and in |
24 | accordance with the general laws governing elections, the Board |
25 | of County Commissioners of Brevard County shall call and the |
26 | Brevard County Supervisor of Elections shall conduct a |
27 | referendum of qualified electors of the county for the purpose |
28 | of posing the following question: |

30 | Shall annual increases in Brevard County's operating budget be |
31 | limited to the percentage change in the county's population in |
32 | addition to the percentage change in the Consumer Price Index |
33 | unless the county commission finds, by a super majority vote, |
34 | that exceeding the limitation is necessary due to emergency or |
35 | critical need? |

38 | (2) "Qualified elector" means a person who is registered |
39 | to vote in a general election held in Brevard County. |
40 | Section 3. This act shall take effect only upon its |
41 | approval by a majority vote of those qualified electors of |
42 | Brevard County voting in a referendum held in accordance with |
43 | section 2, except that this section and section 2 shall take |
44 | effect upon becoming a law. |
