A bill to be entitled
2An act relating to Brevard County; limiting annual
3increases in Brevard County's operating budget; providing
4for exceptions to the limitation; providing a ballot
5statement; requiring a referendum; providing an effective
6date.

8Be It Enacted by the Legislature of the State of Florida:

10     Section 1.  Limitation on increases in the county's
11operating budget.--Except as provided in this section, annual
12increases in Brevard County's operating budget shall not exceed
13the percentage increase in the county's population, as
14determined by the University of Florida Bureau of Economic and
15Business Research's latest Florida Estimates of Population, in
16addition to the percentage change in the Consumer Price Index as
17provided in section 193.155(1)(b), Florida Statutes. This
18limitation in annual increases in the county's operating budget
19may be overcome by a finding of necessity due to emergency or
20critical need approved by a super majority vote of the county
21commission.
22     Section 2.  Referendum.--
23     (1)  In conjunction with the next general election, and in
24accordance with the general laws governing elections, the Board
25of County Commissioners of Brevard County shall call and the
26Brevard County Supervisor of Elections shall conduct a
27referendum of qualified electors of the county for the purpose
28of posing the following question:

30Shall annual increases in Brevard County's operating budget be
31limited to the percentage change in the county's population in
32addition to the percentage change in the Consumer Price Index
33unless the county commission finds, by a super majority vote,
34that exceeding the limitation is necessary due to emergency or
35critical need?

38     (2)  "Qualified elector" means a person who is registered
39to vote in a general election held in Brevard County.
40     Section 3.  This act shall take effect only upon its
41approval by a majority vote of those qualified electors of
42Brevard County voting in a referendum held in accordance with
43section 2, except that this section and section 2 shall take
44effect upon becoming a law.
