A bill to be entitled
2An act relating to Indian River County operating budget
3limitation; limiting annual increases in the county's
4operating budget; providing exceptions to the limitation;
5requiring a referendum subject to an extraordinary vote;
6providing a ballot statement; providing a definition;
7providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Limitation on increases in the county's
12operating budget.--Except as provided herein, annual increases
13in Indian River County's operating budget shall not exceed the
14percentage increase in the county's population, as determined by
15the University of Florida Bureau of Economic and Business
16Research's latest Florida Estimates of Population, plus the
17percentage change in the Consumer Price Index as provided in
18section 193.155(1)(b), Florida Statutes. This limitation in
19annual increases in the county's operating budget may be
20overcome by a finding of necessity due to emergency or critical
21need approved by a super majority vote of the county commission.
22     Section 2.  Referendum.--
23     (1)  In conjunction with the next countywide general
24election, and in accordance with the general laws governing
25elections, the Supervisor of Elections of Indian River County
26shall conduct a referendum of qualified electors of the county
27for the purpose of posing the following question:

29Shall annual increases in Indian River County's operating budget
30be limited to the percentage change in the county's population
31plus the percentage change in the Consumer Price Index unless
32the county commission finds, by a super majority vote, that
33exceeding the limitation is necessary due to emergency or
34critical need?

37     (2)  "Qualified elector" means a person who is registered
38to vote in a general election held in Indian River County.
39     Section 3.  This act shall take effect only upon its
40approval by 60 percent of those qualified electors of the county
41voting in a referendum held in accordance with section 2, except
42that this section and section 2 shall take effect upon becoming
43a law.
