11 Senator Bennett moved the following amendment:

13 Senate Amendment (with directory and title amendments)
14 On page 28, between lines 2 and 3,

16 insert:
17 (8)(a) All fees and moneys collected by the Department
18 of State under this chapter shall be deposited in the Records
19 Management Trust Fund for the purpose of paying for costs
20 incurred by the department in carrying out this chapter.
21 (b) The unencumbered balance in the Records Management
22 Trust Fund for fees collected pursuant to this chapter may not
23 exceed $300,000 at the beginning of each fiscal year, and any
24 excess shall be transferred to the General Revenue Fund.
25 (c) For the 2007-2008 fiscal year only,
26 notwithstanding paragraph (b), the unencumbered balance in the
27 Records Management Trust Fund for fees collected pursuant to
28 this chapter shall not exceed $400,000 at the beginning of
29 each fiscal year, and any excess shall be transferred to the
30 General Revenue Fund. This paragraph expires July 1, 2008.
