A bill to be entitled
2An act relating to persons with developmental
3disabilities; requiring the Agency for Persons with
4Disabilities and the Agency for Health Care Administration
5to establish a pilot project for certain clients who are
6currently served through federal waivers for Medicaid home
7and community-based services and family and supported
8living services; providing requirements for the pilot
9project; requiring the Agency for Persons with
10Disabilities to submit a report to the Governor, the
11Legislature, and legislative committees; requiring
12legislative approval for further expansion; providing an
13effective date.

15Be It Enacted by the Legislature of the State of Florida:

17     Section 1.  Home and community-based waiver pilot
18project.--The Agency for Persons with Disabilities and the
19Agency for Health Care Administration shall make any changes in
20rule and to Medicaid waiver agreements with federal Medicaid
21authorities as are required in order to establish a 5-year pilot
22project that demonstrates strategies and methods for the
23provision of community-based care to clients with developmental
24disabilities who are currently served through Medicaid home and
25community-based services and family and supported living
26services. This project shall document increased client outcomes
27that are known to be associated with a valid needs assessment of
28client level of need, rate setting based on level of need, and
29encouragement of the use of community-centered services and
30supports. The pilot project shall implement strong utilization
31control in order to ensure predictable and controlled annual
32costs. Medicaid service delivery, including, but not limited to,
33service authorization, fee setting, care management, and
34monitoring shall be managed locally through the area office of
35the Agency for Persons with Disabilities in order to encourage
36provider development. The Agency for Persons with Disabilities
37shall submit a report detailing the progress, strategies,
38specific models used, and future directions in this pilot
39project to the Executive Office of the Governor, the President
40of the Senate, the Speaker of the House of Representatives, and
41the health and human services appropriations committees of the
42Legislature by March 1, 2008, and periodically thereafter. The
43pilot project shall be implemented in Area 1 of the Agency for
44Persons with Disabilities. Further expansion of this pilot
45project requires legislative approval.
46     Section 2.  This act shall take effect upon becoming a law.
