  1                      A bill to be entitled

  2         An act relating to disclosure of food

  3         containing trans fats; providing a short title;

  4         creating s. 509.293, F.S.; requiring public

  5         food service establishments serving foods

  6         containing trans fats to post a disclosure;

  7         requiring the Division of Hotels and

  8         Restaurants of the Department of Business and

  9         Professional Regulation to enforce the

10         disclosure requirements; providing a penalty;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  This act may be cited as the "Healthy

16  Dining Act."

17         Section 2.  Section 509.293, Florida Statutes, is

18  created to read:

19         509.293  Disclosure of food containing trans fats.--

20         (1)  Any public food service establishment that

21  prepares, serves, or sells food that contains trans fats or

22  has been prepared with substances that contain trans fats

23  shall post the following disclosure in a conspicuous location:

24  "Some foods served here contain trans fats. Eating foods with

25  trans fats can increase your risk of stroke and heart attack."

26         (2)  The division shall enforce the requirements of

27  this section.

28         (3)  The license of any food service establishment may

29  be suspended or revoked by the division, or the division may

30  impose fines on the licensee, in accordance with the

31  provisions of s. 509.261, when the operator of such

 1  establishment is determined by the division to have violated

 2  any provision of this section.

 3         Section 3.  This act shall take effect July 1, 2007.

 7    Requires that public food service establishments disclose
      the use of trans fats. Requires enforcement by the
 8    Division of Hotels and Restaurants of the Department of
      Business and Professional Regulation.
