6 | Section 3. Subsection (7) is added to section 717.124, |
7 | Florida Statutes, to read: |
8 | 717.124 Unclaimed property claims.-- |
9 | (7) Any person who is entitled to the part of the |
10 | intestate estate not passing to the surviving spouse under s. |
11 | 732.102, or the entire intestate estate if there is no surviving |
12 | spouse; if there are no lineal descendants of the decedent as |
13 | described in s. 732.103(1)-(5), and if the person is a lineal |
14 | descendant of the decedent's great-grandparents who were |
15 | Holocaust victims as defined in s. 626.9543(3)(a), including |
16 | such victims in countries cooperating with the discriminatory |
17 | policies of Nazi Germany; and the property is presumed unclaimed |
18 | property under this chapter may claim an interest in the |
19 | unclaimed property pursuant to subsection (1). The court shall |
20 | allow any such descendant to meet a reasonable, not unduly |
21 | restrictive, standard of proof to substantiate his or her |
22 | lineage. |
