1 A bill to be entitled
2 An act relating to law enforcement vehicles;
3 creating s. 316.21265, F.S.; authorizing law
4 enforcement agencies to use specific off-road
5 vehicles on the streets, roads, and highways of
6 this state; providing requirements for such
7 vehicles; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 316.21265, Florida Statutes, is
12 created to read:
13 316.21265 Use of all-terrain vehicles, golf carts,
14 low-speed vehicles, or utility vehicles by law enforcement
15 agencies.--
16 (1) Notwithstanding any provision of law to the
17 contrary, any law enforcement agency in this state may operate
18 all-terrain vehicles as defined in s. 317.2074, golf carts as
19 defined in s. 320.01(22), low-speed vehicles as defined in s.
20 320.01, or utility vehicles as defined in s. 320.01(43) on any
21 street, road, or highway in this state while carrying out its
22 official duties.
23 (2) Such vehicles must be clearly marked as vehicles
24 of a law enforcement agency and may be equipped with special
25 warning lights, signaling devices, or other equipment approved
26 or authorized for use on law enforcement vehicles.
27 (3) The vehicle operator and passengers must wear
28 safety gear, such as helmets, which is ordinarily required or
29 recommended for use by operators or passengers on such
30 vehicles.
31 Section 2. This act shall take effect July 1, 2007.
