1 A bill to be entitled
2 An act relating to the City of St. Petersburg,
3 Pinellas County; authorizing the Division of
4 Alcoholic Beverages and Tobacco of the
5 Department of Business and Professional
6 Regulation to issue up to a specified number of
7 temporary permits to a nonprofit civic
8 organization to sell alcoholic beverages for
9 consumption on the premises at outdoor events
10 on public right-of-way in the downtown area of
11 St. Petersburg; providing that such events
12 require a street-closure permit from the City
13 of St. Petersburg; providing that the permits
14 authorized by the act are in addition to
15 certain other authorized temporary permits;
16 requiring the nonprofit civic organization to
17 comply with certain statutory requirements in
18 obtaining the permits authorized by the act;
19 requiring the division to adopt rules;
20 providing an effective date.

22 Be It Enacted by the Legislature of the State of Florida:

24 Section 1. (1) Notwithstanding any other provision of
25 law, the Division of Alcoholic Beverages and Tobacco of the
26 Department of Business and Professional Regulation may issue
27 to a bona fide nonprofit civic organization, upon application
28 and presentation of a valid street-closure permit issued by
29 the City of St. Petersburg, a temporary permit authorizing the
30 sale of alcoholic beverages for consumption on the premises at
31 outdoor events on public right-of-way in the downtown area of

1 St. Petersburg. Any such nonprofit civic organization may be
2 issued up to 15 temporary permits per calendar year and each
3 temporary permit is valid for up to 3 days. For purposes of
4 this act, the downtown area of St. Petersburg is that area
5 between 5th Avenues North and South and between 16th Street
6 and the waterfront.
7 (2) The temporary permits authorized by this act are
8 in addition to the three temporary permits authorized per year
9 for a nonprofit civic organization pursuant to s. 561.422,
10 Florida Statutes.
11 (3) The nonprofit civic organization shall comply with
12 all other requirements of s. 561.422, Florida Statutes, in
13 obtaining the temporary permits authorized by this act.
14 (4) On or before October 1, 2007, the Division of
15 Alcoholic Beverages and Tobacco of the Department of Business
16 and Professional Regulation shall adopt rules pursuant to
17 chapter 120, Florida Statutes, to administer this act. Such
18 rules shall include permitting procedures and application
19 forms.
20 Section 2. This act shall take effect upon becoming a
21 law.
