  1                      A bill to be entitled

  2         An act relating to limitations on passing,

  3         changing lanes, or changing course in motor

  4         vehicles; amending s. 316.085, F.S.;

  5         prohibiting driving outside authorized lanes or

  6         within pavement markings or traffic control

  7         devices except where explicitly authorized;

  8         providing exceptions; prohibiting a vehicle

  9         from entering certain queues of slow-moving

10         traffic; providing a penalty; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Present subsection (3) of section 316.085,

16  Florida Statutes, is redesignated as subsection (5), and new

17  subsections (3) and (4) are added to that section, to read:

18         316.085  Limitations on overtaking, passing, changing

19  lanes and changing course.--

20         (3)  A motor vehicle may not be driven outside the

21  authorized lane of travel or over, across, or within a

22  pavement marking or traffic control device for the purpose of

23  overtaking or passing another vehicle except where the

24  pavement marking or traffic control device explicitly

25  authorizes such overtaking or passing. This prohibition does

26  not apply to maneuvers taken to avoid disabled vehicles or

27  obstructions.

28         (4)  A motor vehicle may not be driven from a direct

29  course in a lane on a highway until the driver has determined

30  that the vehicle is not entering a vehicular queue at a point

31  ahead of the last vehicle in the queue. As used in this

 1  subsection, the term "queue" means more than one vehicle

 2  proceeding in the same direction, traveling at less than the

 3  posted speed limit, and aligned in one or more lanes for the

 4  purpose of exiting or entering a roadway, merging, or

 5  traveling through a designated construction zone.

 6         (5)(3)  A violation of this section is a noncriminal

 7  traffic infraction, punishable as a moving violation as

 8  provided in chapter 318.

 9         Section 2.  This act shall take effect July 1, 2007.

13    Prohibits driving outside certain authorized lanes or
      within pavement markings or traffic control devices
14    except where explicitly authorized. Prohibits a vehicle
      from entering a queue of slow-moving traffic ahead of the
15    last vehicle.
