1 A bill to be entitled
2 An act relating to Medicaid services; amending
3 s. 409.905, F.S.; requiring the Agency for
4 Health Care Administration to pay for nutrition
5 therapy services and smoking cessation services
6 for Medicaid recipients; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsections (13) and (14) are added to
12 section 409.905, Florida Statutes, to read:
13 409.905 Mandatory Medicaid services.--The agency may
14 make payments for the following services, which are required
15 of the state by Title XIX of the Social Security Act,
16 furnished by Medicaid providers to recipients who are
17 determined to be eligible on the dates on which the services
18 were provided. Any service under this section shall be
19 provided only when medically necessary and in accordance with
20 state and federal law. Mandatory services rendered by
21 providers in mobile units to Medicaid recipients may be
22 restricted by the agency. Nothing in this section shall be
23 construed to prevent or limit the agency from adjusting fees,
24 reimbursement rates, lengths of stay, number of visits, number
25 of services, or any other adjustments necessary to comply with
26 the availability of moneys and any limitations or directions
27 provided for in the General Appropriations Act or chapter 216.
28 (13) MEDICAL NUTRITION THERAPY SERVICES.--The agency
29 shall pay for nutritional diagnostic therapy and counseling
30 services for the purpose of disease management which are
31 furnished by a registered dietician as defined in s. 468.503

1 or a licensed dietician/nutritionist as defined in s. 468.509
2 pursuant to a referral by a licensed physician.
3 (14) SMOKING CESSATION SERVICES.--The agency shall pay
4 for education, one-on-one counseling, support-group services,
5 and smoking control classes. These services must be referred
6 by a prescribing medical practitioner or a health professional
7 that specializes in coronary heart disease.
8 Section 2. This act shall take effect July 1, 2007.
