1 A bill to be entitled
2 An act relating to the practice of law;
3 amending s. 454.18, F.S.; deleting provisions
4 prohibiting a sheriff, deputy sheriff, clerk,
5 or deputy clerk from practicing law; deleting
6 an exception to the provision prohibiting a
7 sheriff, deputy sheriff, clerk, or deputy clerk
8 from practicing law; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 454.18, Florida Statutes, is
14 amended to read:
15 454.18 Practice of law; self-representation Officers
16 not allowed to practice.--No sheriff or clerk of any court, or
17 deputy thereof, shall practice in this state, nor shall any
18 person not of good moral character, or who has been convicted
19 of an infamous crime be entitled to practice. A But no person
20 may not shall be denied the right to practice law on account
21 of gender sex, race, or color. And Any person, whether an
22 attorney or not, or whether within the exceptions mentioned
23 above or not, may conduct his or her own cause in any court of
24 this state, or before any public board, committee, or officer,
25 subject to the lawful rules and discipline of such court,
26 board, committee, or officer. The provisions of this section
27 restricting the practice of law by a sheriff or clerk, or
28 deputy thereof, shall not apply in a case where such person is
29 representing the office or agency in the course of duties as
30 an attorney.
31 Section 2. This act shall take effect July 1, 2007.
