  1                      A bill to be entitled

  2         An act relating to the practice of law;

  3         amending s. 454.18, F.S.; prohibiting deputy

  4         clerks of the court or deputy sheriffs who are

  5         employed full time from practicing law;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 454.18, Florida Statutes, is

11  amended to read:

12         454.18  Officers not allowed to practice.--No sheriff

13  or clerk of any court, or full-time deputy thereof, shall

14  practice in this state, nor shall any person not of good moral

15  character, or who has been convicted of an infamous crime be

16  entitled to practice. A But no person may not shall be denied

17  the right to practice on account of sex, race, or color. And

18  any person, whether an attorney or not, or whether within the

19  exceptions mentioned above or not, may conduct his or her own

20  cause in any court of this state, or before any public board,

21  committee, or officer, subject to the lawful rules and

22  discipline of such court, board, committee, or officer. The

23  provisions of this section restricting the practice of law by

24  a sheriff or clerk, or full-time deputy thereof, do shall not

25  apply in a case where such person is representing the office

26  or agency in the course of his or her duties as an attorney.

27         Section 2.  This act shall take effect July 1, 2007.
