3     Amendment (with title amendments)
4     Remove everything after the enacting clause and insert:
5     Section 1.  Subsection (1) of section 395.003, Florida
6Statutes, is amended to read:
7     395.003  Licensure; issuance, renewal, denial,
8modification, suspension, and revocation.--
9     (1)(a)  A person may not establish, conduct, or maintain a
10hospital, ambulatory surgical center, or mobile surgical
11facility in this state without first obtaining a license under
12this part.
13     (b)1.  It is unlawful for a person to use or advertise to
14the public, in any way or by any medium whatsoever, any facility
15as a "hospital," "ambulatory surgical center," or "mobile
16surgical facility" unless such facility has first secured a
17license under the provisions of this part.
18     2.  This part does not apply to veterinary hospitals or to
19commercial business establishments using the word "hospital,"
20"ambulatory surgical center," or "mobile surgical facility" as a
21part of a trade name if no treatment of human beings is
22performed on the premises of such establishments.
23     3.  Until July 1, 2006, Additional emergency departments
24located off the premises of licensed hospitals may not be
25authorized by the agency until July 1, 2008, except a hospital
26that has had Stage 2 architectural plans approved for an
27emergency department located off the premises of a licensed
28hospital by April 15, 2007, may be authorized and licensed by
29the agency upon compliance with the same requirements that were
30imposed on off-premises emergency departments licensed prior to
31July 1, 2007.
32     Section 2.  This act shall take effect July 1, 2007.
