3 395.003, F.S.; prohibiting the licensing of
4 additional emergency departments located off
5 the premises of a licensed hospital until
6 January 1, 2009; providing exceptions;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Subsection (1) of section 395.003, Florida
12 Statutes, is amended to read:
13 395.003 Licensure; issuance, renewal, denial,
14 modification, suspension, and revocation.--
15 (1)(a) A person may not establish, conduct, or
16 maintain a hospital, ambulatory surgical center, or mobile
17 surgical facility in this state without first obtaining a
18 license under this part.
19 (b)1. It is unlawful for a person to use or advertise
20 to the public, in any way or by any medium whatsoever, any
21 facility as a "hospital," "ambulatory surgical center," or
22 "mobile surgical facility" unless such facility has first
23 secured a license under the provisions of this part.
24 2. This part does not apply to veterinary hospitals or
25 to commercial business establishments using the word
26 "hospital," "ambulatory surgical center," or "mobile surgical
27 facility" as a part of a trade name if no treatment of human
28 beings is performed on the premises of such establishments.
29 3. Until July 1, 2006, Additional emergency
30 departments located off the premises of licensed hospitals may
31 not be authorized by the agency until January 1, 2009, except

1 that a hospital which has commenced the licensure application
2 process for an emergency department located off the premises
3 of a licensed hospital, including the filing of initial
4 documents on or before April 30, 2007, and has submitted Stage
5 2 architectural plans for an emergency department located off
6 the premises of a licensed hospital as of July 1, 2007, or has
7 received approval of Stage 2 architectural plans for an
8 emergency department located off the premises of a licensed
9 hospital as of July 15, 2007, may be authorized and licensed
10 by the agency upon compliance with the same requirements as
11 were imposed on off-premises emergency departments licensed
12 prior to July 1, 2007.
13 Section 2. This act shall take effect July 1, 2007.
