  1                      A bill to be entitled

  2         An act relating to probable cause for a

  3         warrantless arrest; amending s. 901.15, F.S.;

  4         providing that a law enforcement officer may

  5         arrest a person without a warrant when there is

  6         probable cause to believe that the person has

  7         unlawfully exhibited his or her sexual organs

  8         in public; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (16) is added to section 901.15,

13  Florida Statutes, to read:

14         901.15  When arrest by officer without warrant is

15  lawful.--A law enforcement officer may arrest a person without

16  a warrant when:

17         (16)  There is probable cause to believe that the

18  person has unlawfully exhibited his or her sexual organs in

19  public in violation of s. 800.03.

20         Section 2.  This act shall take effect July 1, 2007.

23                          SENATE SUMMARY

24    Provides that a law enforcement officer may arrest a
      person without a warrant when there is probable cause to
25    believe that the person has unlawfully exhibited his or
      her sexual organs in public.
