14 On page 2, line 17, through
15 page 3, line 15, delete those lines
16
17 and insert:
18 (5) Every enclosed space or room that contains a
19 boiler regulated under chapter 554 which is fired by the
20 direct application of energy from the combustion of fuels and
21 that is located in any portion of a public lodging
22 establishment that also contains sleeping rooms shall be
23 equipped with one or more carbon monoxide sensor devices that
24 bear the label of a nationally recognized testing laboratory
25 and have been tested and listed as complying with the most
26 recent Underwriters Laboratories, Inc., Standard 2034, or its
27 equivalent, unless it is determined that carbon monoxide
28 hazards have otherwise been adequately mitigated as determined
29 by the division. Such devices shall be integrated with the
30 public lodging establishment's fire detection system. Any such
31 installation or determination shall be made in accordance with

1 rules adopted by the division.
2 Section 2. Section 553.885, Florida Statutes, is
3 created to read:
4 553.885 Carbon monoxide alarm required.--
5 (1) Every building for which a building permit is
6 issued for new construction on or after July 1, 2008, and
7 having a fossil-fuel-burning heater or appliance, a fireplace,
8 or an attached garage shall have an approved operational
9 carbon monoxide alarm installed within 10 feet of each room
10 used for sleeping purposes.
11 (2) The Florida Building Commission shall adopt rules
12 to administer this section and shall incorporate such
13 requirements into its next revision of the Florida Building
14 Code.
15 (3) As used in this section, the term:

30 installation of such devices; requiring the
31 Florida Building Commission to adopt rules;

1 providing definitions; providing an effective
2 date.

4 WHEREAS, the general purpose and intent of this act is
5 to provide proper protection regulations in the best interest
6 of the health, safety, and welfare of the citizens of this
7 state, and
8 WHEREAS, the specific intent and purpose of this act is
9 to create safety regulations requiring carbon monoxide
10 detectors after the occurrence of several incidents where
11 people have died as a result of carbon monoxide poisoning
12 under circumstances that were preventable, and
13 WHEREAS, this act honors the memory of Janelle Bertot,
14 a talented and community-oriented 19-year-old college student
15 and daughter of a former Hialeah police officer, and Anthony
16 Perez, a 25-year-old senior at Florida International
17 University and the president of Pi Kappa Phi fraternity, who
18 died on November 14, 2004, from carbon monoxide poisoning as a
19 result of carbon monoxide that leaked from their motor
20 vehicle, and
21 WHEREAS, through the efforts of Janelle's parents and
22 other dedicated volunteers, Janelle's Wishing Well, a
23 charitable foundation, has been established to provide
24 scholarships to young people interested in health care and to
25 raise public awareness and create community outreach programs
26 on the dangers of carbon monoxide poisoning, and
27 WHEREAS, the Legislature recognizes and supports the
28 education and prevention efforts of Janelle's Wishing Well to
29 advise young people of the lethal danger of carbon monoxide
30 poisoning, and
31 WHEREAS, this act also honors the memory of Tom

1 Lueders, an outgoing 26-year-old from Washington, D.C., who
2 was just starting out in a promising career and had
3 aspirations of attending graduate school, and who, on December
4 27, 2006, died from carbon monoxide poisoning, NOW, THEREFORE,
