11  The Committee on Banking and Insurance (Peaden) recommended
12  the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 2, line 16, through
16            page 5, line 12, delete those lines
17  
18  and insert:  
19         Section 1.  Section 553.885, Florida Statutes, is
20  created to read:
21         553.885  Carbon monoxide alarm required.--
22         (1)  This section may be cited as "Janelle's Law."
23         (2)  Every building for which a building permit is
24  issued for new construction on or after July 1, 2008, and
25  having a fossil-fuel-burning heater or appliance, a fireplace,
26  or an attached garage must have an approved operational carbon
27  monoxide alarm installed within 10 feet of each room used for
28  sleeping purposes.
29         (3)  The Florida Building Commission shall adopt rules
30  to administer this section and shall incorporate such
31  requirements into its next revision of the Florida Building

Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 1822 Barcode 210086 1 Code. 2 (4) As used in this section, the term: 3 (a) "Carbon monoxide alarm" means a device that is 4 meant for the purpose of detecting carbon monoxide, that 5 produces a distinct audible alarm, and that meets the 6 requirements of and is approved by the Florida Building 7 Commission. 8 (b) "Fossil fuel" means coal, kerosene, oil, fuel 9 gases, or other petroleum or hydrocarbon product that emits 10 carbon monoxide as a by-product of combustion. 11 12 (Redesignate subsequent sections.) 13 14 15 ================ T I T L E A M E N D M E N T =============== 16 And the title is amended as follows: 17 On page 1, lines 2-15, delete those lines 18 19 and insert: 20 An act relating to carbon monoxide detectors; 21 creating s. 553.885, F.S.; providing a short 22 title; requiring buildings constructed on or 23 after a specified date which have a 24 fossil-fuel-burning appliance, fireplace, or 25 attached garage to have carbon monoxide alarms 26 installed; requiring the Florida Building 27 Commission to adopt rules; providing 28 definitions; providing an effective date. 29 30 31 2 8:51 AM 04/09/07 s1822c-bi02-j03
