  2         An act relating to carbon monoxide detectors;

  3         amending s. 509.211, F.S.; requiring that

  4         certain public lodging establishments be

  5         equipped with carbon monoxide sensor devices;

  6         specifying approved types of devices; providing

  7         requirements for the installation of such

  8         devices; creating s. 553.885, F.S.; requiring

  9         that certain buildings constructed on or after

10         a specified date be equipped with carbon

11         monoxide alarms; providing requirements for the

12         installation of such devices; requiring the

13         Florida Building Commission to adopt rules;

14         providing definitions; providing an effective

15         date.

16  

17         WHEREAS, the general purpose and intent of this act is

18  to provide proper protection regulations in the best interest

19  of the health, safety, and welfare of the citizens of this

20  state, and

21         WHEREAS, the specific intent and purpose of this act is

22  to create safety regulations requiring carbon monoxide

23  detectors after the occurrence of several incidents where

24  people have died as a result of carbon monoxide poisoning

25  under circumstances that were preventable, and

26         WHEREAS, this act honors the memory of Janelle Bertot,

27  a talented and community-oriented 19-year-old college student

28  and daughter of a former Hialeah police officer, and Anthony

29  Perez, a 25-year-old senior at Florida International

30  University and the president of Pi Kappa Phi fraternity, who

31  died on November 14, 2004, from carbon monoxide poisoning as a

 1  result of carbon monoxide that leaked from their motor

 2  vehicle, and

 3         WHEREAS, through the efforts of Janelle's parents and

 4  other dedicated volunteers, Janelle's Wishing Well, a

 5  charitable foundation, has been established to provide

 6  scholarships to young people interested in health care and to

 7  raise public awareness and create community outreach programs

 8  on the dangers of carbon monoxide poisoning, and

 9         WHEREAS, the Legislature recognizes and supports the

10  education and prevention efforts of Janelle's Wishing Well to

11  advise young people of the lethal danger of carbon monoxide

12  poisoning, and

13         WHEREAS, this act also honors the memory of Tom

14  Lueders, an outgoing 26-year-old from Washington, D.C., who

15  was just starting out in a promising career and had

16  aspirations of attending graduate school, and who, on December

17  27, 2006, died from carbon monoxide poisoning, NOW, THEREFORE,

18  

19  Be It Enacted by the Legislature of the State of Florida:

20  

21         Section 1.  Subsection (5) is added to section 509.211,

22  Florida Statutes, to read:

23         509.211  Safety regulations.--

24         (5)  Every enclosed space or room that contains a

25  boiler regulated under chapter 554 which is fired by the

26  direct application of energy from the combustion of fuels and

27  that is located in any portion of a public lodging

28  establishment that also contains sleeping rooms shall be

29  equipped with one or more carbon monoxide sensor devices that

30  bear the label of a nationally recognized testing laboratory

31  and have been tested and listed as complying with the most

 1  recent Underwriters Laboratories, Inc., Standard 2034, or its

 2  equivalent, unless it is determined that carbon monoxide

 3  hazards have otherwise been adequately mitigated as determined

 4  by the division. Such devices shall be integrated with the

 5  public lodging establishment's fire detection system. Any such

 6  installation or determination shall be made in accordance with

 7  rules adopted by the division.

 8         Section 2.  Section 553.885, Florida Statutes, is

 9  created to read:

10         553.885  Carbon monoxide alarm required.--

11         (1)  Every building for which a building permit is

12  issued for new construction on or after July 1, 2008, and

13  having a fossil-fuel-burning heater or appliance, a fireplace,

14  or an attached garage shall have an approved operational

15  carbon monoxide alarm installed within 10 feet of each room

16  used for sleeping purposes.

17         (2)  The Florida Building Commission shall adopt rules

18  to administer this section and shall incorporate such

19  requirements into its next revision of the Florida Building

20  Code.

21         (3)  As used in this section, the term:

22         (a)  "Carbon monoxide alarm" means a device that is

23  meant for the purpose of detecting carbon monoxide, that

24  produces a distinct audible alarm, and that meets the

25  requirements of and is approved by the Florida Building

26  Commission.

27         (b)  "Fossil fuel" means coal, kerosene, oil, fuel

28  gases, or other petroleum or hydrocarbon product that emits

29  carbon monoxide as a by-product of combustion.

30         Section 3.  This act shall take effect July 1, 2007.
