1 A bill to be entitled
2 An act relating to persons with developmental
3 disabilities; requiring the Agency for Persons
4 with Disabilities and the Agency for Health
5 Care Administration to establish a pilot
6 project for certain clients who are currently
7 served through federal waivers for Medicaid
8 home and community-based services and family
9 and supported living services; providing
10 requirements for the pilot project; requiring
11 the Agency for Persons with Disabilities to
12 submit a report to the Governor, the
13 Legislature, and legislative committees;
14 requiring legislative approval for further
15 expansion; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Home and community-based waiver pilot
20 project.--The Agency for Persons with Disabilities and the
21 Agency for Health Care Administration shall make any changes
22 in rule and to Medicaid waiver agreements with federal
23 Medicaid authorities as are required in order to establish a
24 5-year pilot project that demonstrates strategies and methods
25 for the provision of community-based care to clients with
26 developmental disabilities who are currently served through
27 Medicaid home and community-based services and family and
28 supported living services. This project shall document
29 increased client outcomes that are known to be associated with
30 a valid needs assessment of client level of need, rate setting
31 based on level of need, and encouragement of the use of

1 community-centered services and supports. The pilot project
2 shall implement strong utilization control in order to ensure
3 predictable and controlled annual costs. Medicaid service
4 delivery, including, but not limited to, service
5 authorization, fee setting, care management, and monitoring
6 shall be managed locally through the area office of the Agency
7 for Persons with Disabilities in order to encourage provider
8 development. The Agency for Persons with Disabilities shall
9 submit a report detailing the progress, strategies, specific
10 models used, and future directions in this pilot project to
11 the Executive Office of the Governor, the President of the
12 Senate, the Speaker of the House of Representatives, and the
13 health and human services appropriations committees of the
14 Legislature by March 1, 2008, and periodically thereafter. The
15 pilot project shall be implemented in Area 1 of the Agency for
16 Persons with Disabilities. Further expansion of this pilot
17 project requires legislative approval.
18 Section 2. This act shall take effect upon becoming a
19 law.
