  1                      A bill to be entitled

  2         An act relating to persons with developmental

  3         disabilities; requiring the Agency for Persons

  4         with Disabilities and the Agency for Health

  5         Care Administration to establish pilot projects

  6         for certain clients who are currently served

  7         through federal Medicaid home and

  8         community-based services waivers; providing

  9         project requirements; requiring a report;

10         requiring legislative approval for further

11         expansion; requiring an annual review;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Community-based pilot projects.--The Agency

17  for Persons with Disabilities and the Agency for Health Care

18  Administration shall establish pilot projects that demonstrate

19  strategies and methods for the provision of community-based

20  care to clients with developmental disabilities who are

21  currently served through a Medicaid home and community-based

22  services waiver program authorized under s. 409.906(13),

23  Florida Statutes. The projects shall document client outcomes

24  associated with the use of a valid needs assessment of client

25  level of need, set rates based on level of need, and encourage

26  the use of community-centered services and supports. The pilot

27  projects shall establish strong financial controls in order to

28  ensure predictable and controlled annual costs. Medicaid

29  service delivery, including, but not limited to, service

30  authorization, fee setting, care management, and monitoring

31  shall be managed locally through the area offices of the

 1  Agency for Persons with Disabilities in order to encourage

 2  provider development. The Agency for Persons with Disabilities

 3  shall submit a report detailing the progress, strategies,

 4  specific models used, and recommendations for the future

 5  direction of the pilot projects to the Executive Office of the

 6  Governor, the President of the Senate, the Speaker of the

 7  House of Representatives, and the health and human services

 8  appropriations committees of the Legislature by March 1, 2008,

 9  and periodically thereafter. An advisory committee, which

10  includes representation from stakeholders such as families,

11  self-advocates, service providers, and advocacy groups, shall

12  annually evaluate the implementation of the pilot projects.

13  The pilot projects shall be implemented in Area 1, Area 13,

14  and parts of the Suncoast region of the Agency for Persons

15  with Disabilities by July 1, 2007. Further expansion of these

16  pilot projects requires legislative approval. Each pilot

17  program shall be reviewed annually to determine the efficacy

18  of continuation.

19         Section 2.  This act shall take effect upon becoming a

20  law.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 1826

 3                                 

 4  The committee substitute:

 5  -    Directs the Agency for Persons with Disabilities (APD)
         and the Agency for Health Care Administration (AHCA) to
 6       establish pilot projects for APD Area One, Area Thirteen,
         and part of the SunCoast Region to demonstrate strategies
 7       and methods for provision of the Home and Community Based
         Waiver.
 8  
    -    Provides for the creation of an advisory committee which
 9       includes representatives from stakeholders such as
         families, self-advocates, service providers, and advocacy
10       groups to evaluate the pilot projects annually.

11  -    Provides that the pilot projects be implemented by July
         1, 2007.
12  
    -    Provides for an annual review of each pilot program to
13       determine the efficacy of continuation.
