1 A bill to be entitled
2 An act relating to requirements for Medicaid
3 eligibility; amending s. 409.903, F.S.;
4 providing that low-income families that have
5 children are eligible for Medicaid if the
6 family's countable income does not exceed 35
7 percent of the federal poverty level and
8 resource standards do not exceed the applicable
9 standards for Aid to Families with Dependent
10 Children; amending s. 445.029, F.S.; extending
11 the time during which a family that has lost
12 temporary cash assistance due to earnings may
13 remain eligible for Medicaid without
14 reapplication if private insurance is
15 unavailable or unaffordable; providing an
16 effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Paragraph (c) of subsection (1) of section
21 409.903, Florida Statutes, is amended to read:
22 409.903 Mandatory payments for eligible persons.--The
23 agency shall make payments for medical assistance and related
24 services on behalf of the following persons who the
25 department, or the Social Security Administration by contract
26 with the Department of Children and Family Services,
27 determines to be eligible, subject to the income, assets, and
28 categorical eligibility tests set forth in federal and state
29 law. Payment on behalf of these Medicaid eligible persons is
30 subject to the availability of moneys and any limitations
31 established by the General Appropriations Act or chapter 216.

1 (1) Low-income families with children are eligible for
2 Medicaid provided they meet the following requirements:
3 (c) The family's countable income does and resources
4 do not exceed 35 percent of the federal poverty level and
5 resource standards do not exceed the applicable Aid to
6 Families with Dependent Children (AFDC) income and resource
7 standards under the AFDC state plan in effect in July 2006
8 1996, except as amended in the Medicaid state plan to conform
9 as closely as possible to the requirements of the welfare
10 transition program, to the extent permitted by federal law.
11 Section 2. Subsection (1) of section 445.029, Florida
12 Statutes, is amended to read:
13 445.029 Transitional medical benefits.--
14 (1) A family that loses its temporary cash assistance
15 due to earnings shall remain eligible for Medicaid without
16 reapplication during the immediately succeeding 24-month
17 12-month period if private medical insurance is unavailable
18 from the employer or is unaffordable.
19 (a) The family shall be denied Medicaid during the
20 24-month 12-month period for any month in which the family
21 does not include a dependent child.
22 (b) The family shall be denied Medicaid if, during the
23 final second 6 months of the 24-month 12-month period, the
24 family's average gross monthly earnings during the preceding
25 month exceed 185 percent of the federal poverty level.
26 Section 3. This act shall take effect upon becoming a
27 law.
