1 A bill to be entitled
2 An act relating to carbon monoxide safety;
3 amending s. 509.211, F.S.; requiring certain
4 public lodging establishments to be equipped
5 with carbon monoxide sensor devices; providing
6 an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (5) is added to section 509.211,
11 Florida Statutes, to read:
12 509.211 Safety regulations.--
13 (5) Every enclosed space or room containing a boiler
14 that is regulated under chapter 554 and that is fired by the
15 direct application of energy from the combustion of fuels and
16 located in any portion of a public lodging establishment that
17 also contains sleeping rooms must be equipped with one or more
18 carbon monoxide sensor devices bearing the label of a
19 nationally recognized testing laboratory and must have been
20 tested and listed as complying with the most recent
21 Underwriters Laboratories, Inc., Standard 2034, or its
22 equivalent, unless the division has determined that carbon
23 monoxide hazards have otherwise been adequately mitigated.
24 Such devices shall be integrated with the public lodging
25 establishment's fire detection system. Any such installation
26 or determination shall be made in accordance with rules
27 adopted by the division.
28 Section 2. This act shall take effect October 1, 2007.

COMMITTEE SUBSTITUTE FOR

4 The committee substitute for committee substitute clarifies
that public lodging establishments must equip any portion of
5 the establishment that has an enclosed space or room
containing a crtain type of boiler regulated under ch. 554,
6 F.S., and which also contains sleeping rooms, with carbon
monoxide sensor devices. It also clarifies that these sensor
7 devices are not required if the carbon monoxide hazard has
been otherwise adequately mitigated.
