1 A bill to be entitled
2 An act relating to overdue assessments and
3 fees; providing for attorney's fees that result
4 from liens against property which arises from
5 debts owed to a homeowner's association,
6 cooperative association, or condominium
7 association to be paid over 90 days with
8 interest; requiring that property owners be
9 notified of liens against the property by
10 certified or registered mail; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. (1) Any association regulated under
16 chapter 718, chapter 719, or chapter 720, Florida Statutes,
17 which files a lien upon a property covered by the association
18 because the property owner does not pay an assessment or other
19 fee owed to the association must, upon filing the lien, notify
20 the property owner by certified or registered mail.
21 (2) If attorney's fees are assessed against the
22 property owner as a result of the association's efforts to
23 collect the debt that resulted in the lien, the property owner
24 may pay the attorney's fees over a period of 90 days,
25 including interest at the standard interest rate for such
26 debts.
27 Section 2. This act shall take effect July 1, 2007.
