3     Amendment to Amendment (542931) (with title amendments)
4Between lines 86 and 87, insert:
5     Section 5.  Paragraph (a) of subsection (4) of section
6316.614, Florida Statutes, is amended to read:
7     316.614  Safety belt usage.--
8     (4)  It is unlawful for any person:
9     (a)  To operate a motor vehicle in this state unless each
10passenger and the operator of the vehicle under the age of 21 18
11years are restrained by a safety belt or by a child restraint
12device pursuant to s. 316.613, if applicable; or
13     (8)  Any person who violates the provisions of this section
14commits a nonmoving violation, punishable as provided in chapter
15318. However, except for violations of s. 316.613 and paragraph
16(4)(a), enforcement of this section by state or local law
17enforcement agencies must be accomplished only as a secondary
18action when a driver of a motor vehicle has been detained for a
19suspected violation of another section of this chapter, chapter
20320, or chapter 322.
