  1                      A bill to be entitled

  2         An act relating to the Florida Building Code;

  3         providing that the internal design option of

  4         the Florida Building Code remains in effect

  5         until a specified date for a building permit

  6         application made before that date,

  7         notwithstanding provisions of ch. 2007-1, Laws

  8         of Florida; providing an effective date and for

  9         retroactive application; applying the act to

10         any actions taken with respect to a building

11         permit affected by such prior act.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Notwithstanding section 9 of chapter

16  2007-1, Laws of Florida, the internal design option provided

17  in Section 1609.1.4.1, Florida Building Code, Building Volume,

18  and Section R301.2.1.2, Florida Building Code, Residential

19  Volume, shall remain in effect until June 1, 2007, for a

20  building permit application made before that date.

21         Section 2.  This act shall take effect upon becoming a

22  law and applies retroactively to January 25, 2007, the

23  effective date of chapter 2007-1, Laws of Florida. This act

24  applies to any action taken with respect to a building permit

25  affected by section 9 of chapter 2007-1, Laws of Florida,

26  including any actions, legal or ministerial, pertaining to the

27  issuance, revocation, or modifications of any building permit

28  initiated or issued before, on, or after January 25, 2007, or

29  pending as of January 25, 2007. If the retroactivity of any

30  provision of this act or its retroactive application to any

31  person or circumstance is held invalid, the invalidity does

 2  other provisions of this act.

 4          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 5                         Senate Bill 1870

 6                                 

 7  Retains the internal design options in the Florida Building
    Code until June 1, 2007 for a building permit application made
 8  prior to that date.

 9  Provisions of the bill apply retroactively to January 25, 2007
    and apply  to any action taken on a building permit affected
10  by Section 9 or Chapter 2007-1, Laws of Florida.
