  1                      A bill to be entitled

  2         An act relating to sexual offenders; amending

  3         s. 943.0435, F.S.; providing that a sexual

  4         offender who does not register with the

  5         Department of Law Enforcement as required by

  6         law is subject to certain terms and conditions

  7         of probation; amending s. 948.03, F.S.;

  8         prohibiting a sexual offender from having

  9         contact with children if the sexual offender

10         does not register with the department;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Present paragraphs (c) and (d) of

16  subsection (9) of section 943.0435, Florida Statutes, are

17  redesignated as paragraphs (d) and (e), respectively, and a

18  new paragraph (c) is added to that subsection, to read:

19         943.0435  Sexual offenders required to register with

20  the department; penalty.--

22         (c)  A sexual offender who does not register as

23  required by this section is subject to the terms and

24  conditions of probation set forth in s. 948.03(1)(o).

25         Section 2.  Paragraph (o) is added to subsection (1) of

26  section 948.03, Florida Statutes, to read:

27         948.03  Terms and conditions of probation.--

28         (1)  The court shall determine the terms and conditions

29  of probation. Conditions specified in this section do not

30  require oral pronouncement at the time of sentencing and may

31  be considered standard conditions of probation. These

 1  conditions may include among them the following, that the

 2  probationer or offender in community control shall:

 3         (o)  Have no contact with children at any time if the

 4  offender or probationer is a sexual offender as defined in s.

 5  943.0435(1) who did not register as required by s. 943.0435.

 6         Section 3.  This act shall take effect July 1, 2007.

 9                          SENATE SUMMARY

10    Provides that a sexual offender who does not register
      with the Department of Law Enforcement as required by law
11    is subject to certain terms and conditions of probation.
      Prohibits a sexual offender from having contact with
12    children if the sexual offender does not register with
      the department.
