1 A bill to be entitled
2 An act relating to specialty license plates;
3 amending s. 320.08056, F.S.; establishing
4 annual use fees for the Florida NASCAR license
5 plate; authorizing placement of a sponsoring
6 organization's Internet domain name on
7 specialty license plates; requiring the
8 specialty license plate application form to
9 provide the applicant the option to instruct
10 the Department of Highway Safety and Motor
11 Vehicles to provide certain information to the
12 sponsoring organization; amending s. 320.08058,
13 F.S.; creating the Florida NASCAR license
14 plate; providing for the distribution of use
15 fees received from the sale of such plates to
16 the Florida Sports Foundation, the National
17 Association for Stock Car Auto Racing, and the
18 NASCAR Foundation; requiring the Florida Sports
19 Association to provide for an annual audit to
20 be submitted to the Office of Tourism, Trade,
21 and Economic Development for certification to
22 the Auditor General; providing an effective
23 date.

25 WHEREAS, the NASCAR Foundation is committed to helping
26 improve the lives of people, including those in need, and
27 WHEREAS, the NASCAR Foundation endeavors to create as
28 many avenues as possible through which people can enrich the
29 lives of children with chronic and medical conditions or
30 serious illnesses, assist children in need, educate and
31 inspire, and advance family values among youth, and

1 WHEREAS, the Florida NASCAR license plate will serve
2 these very important functions and will, by example, encourage
3 others to do the same, NOW, THEREFORE,

5 Be It Enacted by the Legislature of the State of Florida:
6
7 Section 1. Subsection (6) of section 320.08056,
8 Florida Statutes, is amended, paragraph (iii) is added to
9 subsection (4), and subsection (11) is added to that section,
10 to read:
11 320.08056 Specialty license plates.--
12 (4) The following license plate annual use fees shall
13 be collected for the appropriate specialty license plates:
14 (iii) Florida NASCAR license plate, $25.
15 (6) Specialty license plates must bear the design
16 required by law for the appropriate specialty license plate,
17 and the designs and colors must conform to the department's
18 design specifications. In addition to a design, the specialty
19 license plates may bear the imprint of numerals from 1 to 999,
20 inclusive, capital letters "A" through "Z," or a combination
21 thereof. The department shall determine the maximum number of
22 characters, including both numerals and letters. All specialty
23 license plates must be otherwise of the same material and size
24 as standard license plates issued for any registration period.
25 A specialty license plate may bear an appropriate slogan,
26 emblem, or logo in a size and placement that conforms to the
27 department's design specifications. The sponsoring
28 organization's Internet domain name may appear on the plate.
29 (11) The application form for a specialty license
30 plate shall provide the applicant the option to instruct the

1 department to provide his or her name, address, and renewal
2 date to the sponsoring organization.
3 Section 2. Subsection (61) is added to section
4 320.08058, Florida Statutes, to read:
5 320.08058 Specialty license plates.--
6 (61) FLORIDA NASCAR LICENSE PLATES.--
7 (a) The department shall develop a Florida NASCAR
8 license plate as provided in this section. Florida NASCAR
9 license plates must bear the colors and design approved by the
10 department. The word "Florida" must appear at the top of the
11 plate, and the term "NASCAR" must appear at the bottom of the
12 plate. The National Association for Stock Car Auto Racing,
13 following consultation with the Florida Sports Foundation, may
14 submit a sample plate for consideration by the department.
15 (b) The license plate annual use fees shall be
16 distributed to the Florida Sports Foundation, a direct-support
17 organization of the Office of Tourism, Trade, and Economic
18 Development. The license plate annual use fees are to be
19 annually allocated as follows:
20 1. Up to 5 percent of the proceeds from the annual use
21 fees may be used by the Florida Sports Foundation for the
22 administration of the NASCAR license plate program.
23 2. The National Association for Stock Car Auto Racing
24 shall receive up to $80,000 in proceeds from the annual use
25 fees to be used to pay startup costs, including costs incurred
26 in developing and issuing the plates. Thereafter, 10 percent
27 of the proceeds from the annual use fees shall be provided to
28 the association for the royalty rights for the use of their
29 marks.
30 3. The remaining proceeds from the annual use fees
31 shall be distributed to the Florida Sports Foundation. The

1 Florida Sports Foundation will retain 15 percent to support
2 their regional grant program, attracting sporting events to
3 Florida; 20 percent to support the marketing of
4 motorsports-related tourism in the state; and 50 percent to be
5 paid to the NASCAR Foundation, an s. 501(c)(3) charitable
6 organization, to support Florida-based charitable
7 organizations.
8 (c) The Florida Sports Foundation shall provide an
9 annual financial audit in accordance with s. 215.981 of its
10 financial accounts and records by an independent certified
11 public accountant pursuant to the contract established by the
12 Office of Tourism, Trade, and Economic Development as
13 specified in s. 288.1229(5). The auditor shall submit the
14 audit report to the Office of Tourism, Trade, and Economic
15 Development for review and approval. If the audit report is
16 approved, the office shall certify the audit report to the
17 Auditor General for review.
18 Section 3. This act shall take effect July 1, 2007.
