1 A bill to be entitled
2 An act relating to independent special
3 districts; amending s. 189.404, F.S.;
4 requiring, by a specified date, that the
5 governing board of an independent special
6 district having ad valorem taxing power be
7 elected; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:
10
11 Section 1. Subsection (6) is added to section 189.404,
12 Florida Statutes, to read:
13 189.404 Legislative intent for the creation of
14 independent special districts; special act prohibitions; model
15 elements and other requirements; general-purpose local
16 government/Governor and Cabinet creation authorizations.--
17 (6) TAXING AUTHORITY.--By December 31, 2012, the
18 governing board of an independent special district that has ad
19 valorem taxing authority must be elected in accordance with s.
20 189.4051. Each district shall amend its charter to conform to
21 this requirement by July 1, 2011. The Legislature may adopt a
22 schedule for amending individual district charters. Any
23 provision of general or special law existing on July 1, 2012,
24 in conflict with this section shall not be effective to the
25 extent of such conflict.
26 Section 2. This act shall take effect upon becoming a
27 law.
