1 A bill to be entitled
2 An act relating to assisted living facilities;
3 amending s. 429.52, F.S.; requiring the
4 Department of Elderly Affairs to adopt a
5 curriculum for training staff at an assisted
6 living facility; authorizing the department to
7 consult with certain associations; requiring
8 that such training be conducted by persons
9 registered with the department; providing
10 requirements for a person seeking registration
11 with the department; requiring additional
12 criteria for registration as a trainer;
13 requiring the department to adopt rules;
14 providing appropriations and authorizing an
15 additional position; providing an effective
16 date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Subsection (8) of section 429.52, Florida
21 Statutes, is amended, and subsections (9), (10), and (11) are
22 added to that section, to read:
23 429.52 Staff training and educational programs; core
24 educational requirement.--
25 (8) The department shall adopt rules related to these
26 training requirements, the competency test, necessary
27 procedures, and competency test fees and shall adopt, or
28 contract with another entity to develop, a curriculum that
29 shall be used as the minimum core training requirement. The
30 department may consult with representatives of stakeholder

1 agencies and associations in the development of the
2 curriculum.
3 (9) The training required by this section shall be
4 conducted by persons registered with the department as having
5 the requisite experience and credentials to conduct the
6 training. A person seeking to register as a trainer shall
7 provide the department with proof of completion of the minimum
8 core training education requirements, and successful passage
9 of the core competency test established in this section. Such
10 person shall further provide the department with proof of
11 maintaining continuing education requirements as specified in
12 subsection (4).
13 (10) A person seeking to register as a trainer shall
14 also meet one of the following criteria:
15 1. Have proof of completion of a 4-year degree from an
16 accredited college or university and have worked in a
17 management position in an assisted living facility for 3 years
18 since completing the core education requirements and being
19 certified;
20 2. Have worked in a management position in an assisted
21 living facility for 5 years since completing the core
22 education requirements and being certified and have 1 year of
23 teaching experience as an educator or staff trainer for
24 persons who work in assisted living facilities or other
25 long-term care settings;
26 3. Have been previously employed as a trainer of core
27 education requirements for the department; or
28 4. Meets other qualification criteria as defined in
29 rule, which the department is authorized to adopt.
30 (11) The department shall adopt rules for establishing
31 requirements for registering as a trainer.

1 Section 2. For the 2007-2008 fiscal year, funds shall
2 be appropriated from the General Revenue Fund to the
3 Department of Elderly Affairs for the purpose of paying the
4 salary and other administrative expenses for one full-time
5 equivalent position of a Senior Management Analyst II to
6 implement this act. Recurring funds shall be appropriated in
7 the amounts of $63,079 for salary and benefits, $6,489 for
8 expenses, and $401 for human resources services. Nonrecurring
9 funds shall be appropriated in the amounts of $3,426 for
10 expenses and $1,300 for operating capital outlay.
11 Section 3. This act shall take effect upon becoming a
12 law.

17 The committee substitute removes the criterion that a person
be employed for one year by the Agency for Health Care
18 Administration as an assisted living facility surveyor from a
list of four criteria, of which a registered trainer must meet
19 at least one. The committee substitute provides that the
Department of Elderly Affairs can, by rule, define other
20 qualification criteria a person must meet to register as a
trainer. The committee substitute provides that the
21 appropriation will come from the General Revenue Fund.
