11 The Committee on Transportation (Webster) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 49, between lines 21 and 22,

17 insert:
18 Section 17. Section 339.282, Florida Statutes, is
19 created to read:
20 339.282 Transportation concurrency incentives.--The
21 Legislature finds that allowing private-sector entities to
22 finance, construct, and improve public transportation
23 facilities can provide significant benefits to the citizens of
24 this state by facilitating transportation of the general
25 public without the need for additional public tax revenues. In
26 order to encourage the more efficient and proactive provision
27 of transportation improvements by the private sector, if a
28 developer or property owner voluntarily contributes
29 right-of-way and physically constructs or expands a state
30 transportation facility or segment, and such construction or
31 expansion improves traffic flow, capacity, or safety, the

1 voluntary contribution may be applied as a credit for that
2 property owner or developer against any future transportation
3 concurrency requirements pursuant to chapter 163, provided
4 such contributions and credits are set forth in a legally
5 binding agreement executed by the property owner or developer,
6 the local government of the jurisdiction in which the facility
7 is located, and the department. If the developer or property
8 owner voluntarily contributes right-of-way and physically
9 constructs or expands a local government facility or segment
10 and such construction or expansion meets the requirements in
11 this section and is set forth in a legally binding agreement
12 between the property owner or developer and the applicable
13 local government, the contribution to the local government
14 collector and the arterial system may be applied as credit
15 against any future transportation concurrency requirements
16 pursuant to chapter 163.
