11  Senator Alexander moved the following amendment:

13         Senate Amendment (with directory and title amendments) 
14         On page 24, between lines 2 and 3,
15  
16  insert:  
17         (1)  CHARTER COUNTY TRANSPORTATION TRANSIT SYSTEM
18  SURTAX.--
19         (a)  Each charter county that has which adopted a
20  charter prior to January 1, 1984, and each county the
21  government of which is consolidated with that of one or more
22  municipalities, may levy a discretionary sales surtax, subject
23  to approval by a majority vote of the electorate of the county
24  or by a charter amendment approved by a majority vote of the
25  electorate of the county.
26         (b)  The rate shall be up to 1 percent.
27         (c)  The proposal to adopt a discretionary sales surtax
28  as provided in this subsection and to create a trust fund
29  within the county accounts shall be placed on the ballot in
30  accordance with law at a time to be set at the discretion of
31  the governing body.

Florida Senate - 2007 SENATOR AMENDMENT Bill No. CS for CS for CS for SB 1928 Barcode 780632 1 (d) Proceeds from the surtax shall be applied to as 2 many or as few of the uses enumerated below in whatever 3 combination the county commission deems appropriate: 4 1. Deposited by the county in the trust fund and shall 5 be used for the purposes of development, construction, 6 equipment, maintenance, operation, supportive services, 7 including a countywide bus system, and related costs of a 8 fixed guideway rapid transit system; 9 2. Remitted by the governing body of the county to an 10 expressway, transit, or transportation authority created by 11 law to be used, at the discretion of such authority, for the 12 development, construction, operation, or maintenance of roads 13 or bridges in the county, for the operation and maintenance of 14 a bus system, for the payment of principal and interest on 15 existing bonds issued for the construction of such roads or 16 bridges, and, upon approval by the county commission, such 17 proceeds may be pledged for bonds issued to refinance existing 18 bonds or new bonds issued for the construction of such roads 19 or bridges; 20 3. Used by the charter county for the development, 21 construction, operation, and maintenance of roads and bridges 22 in the county; for the expansion, operation, and maintenance 23 of bus and fixed guideway systems; and for the payment of 24 principal and interest on bonds issued for the construction of 25 fixed guideway rapid transit systems, bus systems, roads, or 26 bridges; and such proceeds may be pledged by the governing 27 body of the county for bonds issued to refinance existing 28 bonds or new bonds issued for the construction of such fixed 29 guideway rapid transit systems, bus systems, roads, or bridges 30 and no more than 25 percent used for nontransit uses; and 31 4. Florida Senate - 2007 SENATOR AMENDMENT Bill No. CS for CS for CS for SB 1928 Barcode 780632 1 development, construction, operation, and maintenance of roads 2 and bridges in the county; for the planning, development, 3 expansion, operation, and maintenance of bus and fixed 4 guideway systems; and for the payment of principal and 5 interest on bonds issued for the construction of fixed 6 guideway rapid transit systems, bus systems, roads, or 7 bridges; and such proceeds may be pledged by the governing 8 body of the county for bonds issued to refinance existing 9 bonds or new bonds issued for the construction of such fixed 10 guideway rapid transit systems, bus systems, roads, or 11 bridges. Pursuant to an interlocal agreement entered into 12 pursuant to chapter 163, the governing body of the charter 13 county may distribute proceeds from the tax to a municipality, 14 or an expressway or transportation authority created by law to 15 be expended for the purpose authorized by this paragraph. 16 17 18 ==== D I R E C T O R Y C L A U S E A M E N D M E N T ==== 19 And the directory clause is amended as follows: 20 On page 23, lines 18 and 19, delete those lines 21 22 and insert: 23 Section 8.
