11 The Committee on Transportation (Joyner) recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 61, between lines 6 and 7,
16
17 insert:
18 Section 27. Subsection (2) of section 255.20, Florida
19 Statutes, is amended to read:
20 255.20 Local bids and contracts for public
21 construction works; specification of state-produced lumber.--
22 (2) The threshold amount of $400,000 $200,000 for
23 construction or $100,000 $50,000 for electrical work must be
24 adjusted by the percentage change in the Consumer Price Index
25 from January 1, 2007 1994, to January 1 of the year in which
26 the project is scheduled to begin.
27 Section 28. Subsection (3) of section 336.41, Florida
28 Statutes, is amended to read:
29 336.41 Counties; employing labor and providing road
30 equipment; accounting; when competitive bidding required.--
31 (3) All construction and reconstruction of roads and

1 bridges, including resurfacing, full scale mineral seal
2 coating, and major bridge and bridge system repairs, to be
3 performed utilizing the proceeds of the 80-percent portion of
4 the surplus of the constitutional gas tax shall be let to
5 contract to the lowest responsible bidder by competitive bid,
6 except for:
7 (a) Construction and maintenance in emergency
8 situations, and
9 (b) In addition to emergency work, construction and
10 reconstruction, including resurfacing, mineral seal coating,
11 and bridge repairs, having a total cumulative annual value not
12 to exceed 5 percent of its 80-percent portion of the
13 constitutional gas tax or $400,000 $250,000, whichever is
14 greater,

16 for which the county may utilize its own forces. However, if,
17 after proper advertising, no bids are received by a county for
18 a specific project, the county may use its own forces to
19 construct the project, notwithstanding the limitation of this
20 subsection. Nothing in this section shall prevent the county
21 from performing routine maintenance as authorized by law.
