12 the following amendment:

15 On page 20, line 25 through page 21, line 21, delete
16 those lines

18 and insert:
19 Section 10. Subsection (3) of section 336.41, Florida
20 Statutes, is amended to read:
21 336.41 Counties; employing labor and providing road
22 equipment; accounting; when competitive bidding required.--
23 (3) All construction and reconstruction of roads and
24 bridges, including resurfacing, full scale mineral seal
25 coating, and major bridge and bridge system repairs, to be
26 performed utilizing the proceeds of the 80-percent portion of
27 the surplus of the constitutional gas tax shall be let to
28 contract to the lowest responsible bidder by competitive bid,
29 except for:
30 (a) Construction and maintenance in emergency
31 situations, and

1 (b) In addition to emergency work, construction and
2 reconstruction, including resurfacing, mineral seal coating,
3 and bridge repairs, having a total cumulative annual value not
4 to exceed 5 percent of its 80-percent portion of the
5 constitutional gas tax or $400,000 $250,000, whichever is
6 greater, and
7 (c) Construction of sidewalks, curbing, accessibility
8 ramps or appurtenances incidental to roads and bridges where
9 each project is estimated in accordance with generally
10 accepted cost-accounting principles to have total construction
11 project costs of less than $400,000, or as adjusted by the
12 percentage change in the Construction Cost Index from January
13 1, 2008,

15 for which the county may utilize its own forces. However, if,
16 after proper advertising, no bids are received by a county for
17 a specific project, the county may use its own forces to
18 construct the project, notwithstanding the limitation of this
19 subsection. Nothing in this section shall prevent the county
20 from performing routine maintenance as authorized by law.
