  1                      A bill to be entitled

  2         An act relating to compensation for victims of

  3         crime; amending s. 960.03, F.S.; redefining the

  4         term "crime" to include the offense of

  5         vehicular homicide in the second degree as an

  6         eligible offense for which an innocent victim

  7         may collect compensation; amending s. 960.065,

  8         F.S.; providing that a person who offers

  9         testimony of other crimes is eligible to

10         receive a compensation award; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Paragraph (b) of subsection (3) of section

16  960.03, Florida Statutes, is amended to read:

17         960.03  Definitions; ss. 960.01-960.28.--As used in ss.

18  960.01-960.28, unless the context otherwise requires, the

19  term:

20         (3)  "Crime" means:

21         (b)  A violation of s. 316.193, s. 316.027(1), s.

22  327.35(1), s. 782.071 s. 782.071(1)(b), or s. 860.13(1)(a)

23  which results in physical injury or death; however, no other

24  act involving the operation of a motor vehicle, boat, or

25  aircraft which results in injury or death shall constitute a

26  crime for the purpose of this chapter unless the injury or

27  death was intentionally inflicted through the use of such

28  vehicle, boat, or aircraft or unless such vehicle, boat, or

29  aircraft is an implement of a crime to which this act applies.

30         Section 2.  Subsection (1) of section 960.065, Florida

31  Statutes, is amended to read:

 1         960.065  Eligibility for awards.--

 2         (1)  Except as provided in subsection (2), the

 3  following persons shall be eligible for awards pursuant to

 4  this chapter:

 5         (a)  A victim.

 6         (b)  An intervenor.

 7         (c)  A surviving spouse, parent or guardian, sibling,

 8  or child of a deceased victim or intervenor.

 9         (d)  Any other person who is dependent for his or her

10  principal support upon a deceased victim or intervenor.

11         (e)  A person who is or was a victim in another crime

12  or case and whose testimony is proffered under s. 90.404(2).

13         Section 3.  This act shall take effect July 1, 2007.

16                          SENATE SUMMARY

17    Revises the definition of the term "crime" to include the
      offense of vehicular homicide in the second degree as an
18    eligible offense for which an innocent victim may collect
      compensation. Provides that a person who offers testimony
19    of other crimes is eligible to receive a compensation
      award.
