  1                      A bill to be entitled

  2         An act relating to learner's driver's licenses;

  3         amending s. 322.1615, F.S.; prohibiting a motor

  4         vehicle operator who holds a learner's driver's

  5         license from using a mobile telephone or

  6         personal communication device while operating a

  7         vehicle; providing a penalty; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsections (3) and (4) of section

13  322.1615, Florida Statutes, are amended to read:

14         322.1615  Learner's driver's license.--

15         (3)  A person who holds a learner's driver's license:

16         (a)  May operate a vehicle only during daylight hours,

17  except that the holder of a learner's driver's license may

18  operate a vehicle until 10 p.m. after 3 months following the

19  issuance of the learner's driver's license.

20         (b)  May not operate a mobile telephone or personal

21  communication device while operating a motor vehicle.

22         (4)  A licensee who violates subsection (2) or

23  subsection (3) is subject to the civil penalty imposed for a

24  moving violation as set forth in chapter 318.

25         Section 2.  This act shall take effect July 1, 2007.

29    Prohibits the operation of a mobile telephone or personal
      communication device by a person holding a learner's
30    driver's license while operating a motor vehicle.
