  1                      A bill to be entitled

  2         An act relating to mental health facilities;

  3         amending s. 394.458, F.S.; revising a provision

  4         prohibiting a person from transmitting

  5         contraband to a patient in a hospital;

  6         providing a penalty; providing an effective

  7         date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 394.458, Florida Statutes, is

12  amended to read:

13         394.458  Introduction or removal of certain articles

14  unlawful; penalty.--

15         (1)(a)  Except as authorized by law or as specifically

16  authorized by the person in charge of each hospital providing

17  mental health services under this part, it is unlawful to

18  introduce into or upon the grounds of such hospital, or to

19  take or attempt to take or send therefrom, any of the

20  following articles, which are hereby declared to be contraband

21  for the purposes of this section:

22         1.  Any intoxicating beverage or beverage which causes

23  or may cause an intoxicating effect;

24         2.  Any controlled substance as defined in chapter 893;

25  or

26         3.  Any firearms or deadly weapon.

27         (b)  It is unlawful to transmit to, or attempt to

28  transmit to, or cause or attempt to cause to be transmitted

29  to, or received by, any patient of any hospital providing

30  mental health services under this part any article or thing

31  declared by this section to be contraband, in or on the

 1  grounds of the hospital, or at any place that which is outside

 2  of the grounds of such hospital, except as authorized by law

 3  or as specifically authorized by the person in charge of such

 4  hospital.

 5         (2)  A person who violates any provision of this

 6  section commits a felony of the third degree, punishable as

 7  provided in s. 775.082, s. 775.083, or s. 775.084.

 8         Section 2.  This act shall take effect July 1, 2007.
